who is responsible? compo claim

on delivery delivered to house (council house) on the way out of delivery point slipped on some decking which the occupaints of the house had put down for there elderly mum? wet greasy surface slipped on the home made ramp made from decking wood.now i think its the council i shall be claming off due they own the house?

Why does someone have to be "responsible" ? :roll:

Can you not be responsible for thinking "It's been raining :hmmmm ...... That's a ramp :hmmmm ramps are not as stable as steps :hmmmm .....it might be slippy :hmmmm.....as a grown adult, i think i will take extra care on that bit :hmmmm " Especialy as you will of *seen it loads of times before / Never seen it before

Home owner is responsible but you should first report it to your DOM to fill in an accident report (ERICA) and then to progress your claim you should use the CWU solicitors (one of the reason we pay our dues).

Have you broken something or will it cause you to be off work long term sick.

You will need a fairly serious injury to issue a claim and have to suffered a loss or will so in the future. :hmmmm

fracture off for about 10 weeks,my mate got 7,000 for brocken finger done at work,just waiting for papers from union,

not being funny chap but accidents to happen in all walks of life.i never slipped on it when it was ice ey.

I should think you have deffo got a claim. Be warned that RM may claim some back for sick pay though. :sad:

As suggested above CWU claims dept should sort it out.

I personally don't ever walk on wet decking...........just like I don't walk on moss covered paths......too much danger of going on your arse and then ending up getting a blameworthy, better to just bring the post back and deliver the next day :Very Happy

royalmail were quick enough to send us out on delivery when ice on pavements where it impossible to avoid treading on at times.

iv been through all the correct paper work photos extra,royalmail shoes bag over shoulder (empty) last bundle in hand,not reading while walking or doing anything what would put me at risk,3 managers came out to me,prob because they dont belive you.lol.1st thing they asked how many bags iv got left,that because they might get wet delivering wats left.

How are you going to show negligence on the part of the council unless you can prove that they were aware of the existence and dangerous condition of the ramp?
If the ramp was fitted by the tenant the ramp is the tenants responsibility...good luck with that.

If you slip on a pool of water inside a building open to the public such as a bank, a supermarket or a restaurant and injure yourself, then the personal injury compensation claim would be made against the occupier’s public liability insurance policy.

If your accident was on a council owned property such as a public footpath or a council house rented out to a member of the public, then you may be able to make a personal injury compensation claim against the local authority if the accident was due to their negligence. For example, you may be able to make a personal injury compensation claim if you tripped and injured yourself on a badly maintained footpath; however, you would not be able to make a personal injury compensation claim against the council if you tripped on an item left lying around within a council owned property by the tenant unless you could show that the council itself was in some way at fault. You could of course claim against the tenant but this is unlikely to be worthwhile unless the tenant has relevant insurance cover.

If your accident was on private property such as a house or piece of land privately owned by an individual, you would be able to make a personal injury compensation claim providing the accident was the fault of the land owner or occupier and they had suitable insurance in force or the means to pay personally.

If you tripped on a cable trailing along the floor in your office at work and injured yourself, you would be able to make a personal injury compensation claim against your employer.

Just wanted to say good luck with the recovery. 4 n a bloody half months now my daughter's been in cast, has now managed to dislocate the opposite knee. Poor cow had a year of it. Back to Fracture Clinic on Monday, keep yer fingers crossed.

Is she rich this elderly mum, mind you seems a bit of a complicated plan by them to get at their inheritance early. Probably disappointed that you set it off early as well. :chuckle :chuckle
