working your scedule attendance while on leave
i would be obliged if we have clear directions on this
can an opg come in and do his SA while on leave for that week
the argument is that as its only a five day week out of seven, they are counting the saturday as their day off to come in on a thursday for instance
i am of the opinion that if you are on leave then your week is sunday to sunday and that it is not permitted to work an SA WHILE ON HOLIDAY
i am asking this because an SA is a seperate contract and is an addition to your normal working criteria
i do not want to come accross as a kill joy but clarification is needed

The SA Agreement linked above does not show anything specific to leave and not doing SA, but it does say in relation to absences: "absence through the entitled period of annual leave would be an adequate reason, as would be notified sick leave" so the agreement does not rule out doing SA whilst on leave.

You can't do any work while on annual leave.
It is in The Way Forward Agreement.

Employees may not attend the office whilst on annual or other leave. This means that employees may not attend the office to work overtime or Scheduled Attendance.

SA holiday payment
http://www.royalmailchat.co.uk/communit ... 45#p469942" onclick="window.open(this.href);return false;
3) The purpose of the SA holiday payment is to ensure that employees who regularly work SA receive some earnings support to cover their main paid annual holidays.
Do they want to be paid twice?

Re: working your scedule attendance while on leave
yes it is against the way forward agreement, but is not against the law, employees are free to work their annual leave if they wish to no law against it, the law only states they must be able to take annual leave,
so coming in and working on your annual leave on schedule attendance or even to cover another shift is not illegal, yes they are getting paid twice once for their holiday and once for working the extra hours against that in anyway,
again yes i agree its against the way forward agreement but not against the law unfortuanately

Just had the same thing stopped in our office and I used the way forward agreement clash quoted.

Has happened on numerous occasions in my office. It is just pure greed, and sadly it is normally the 'favourites'.

Re: working your scedule attendance while on leave
i am now going to upset the apple cart
people mention its not against the law to work your leave, that may be true but a national agreement is what it states, a national agreement (way forward)
as more than 51 % of employees in royal mail are members of the CWU, it is the CWU who make collective decisions on our behalf. those decisions in a sense are law and will stand up to scrutiny in any employment tribunal
these national agreements are the only time that statute provision can be over turned as its deemed that the trade union is acting in our best interests
so it may not be against the law as such but it is contrary to a national agreement and as such, royal mail are breaking legislation by allowing this practice
its a def no, no

Re: working your scedule attendance while on leave
i totally agree on the comment above
agreements are their for a reason, good or bad
some may be unpopular to the members, especially to the docket grabbers, but tough
the reps need to be educated in this and take action, after all
they still get paid for the SA even when on holiday

Re: working your scedule attendance while on leave
then you also have a similar situation where some people start a scheduled attendance shift before the end of their normal duty time and are paid twice for same hours,
problem that the union would have is if they were seen to start clamping down on these "perks" that more than a few people have managed to negotiate for themselves and it was the union being seen to clamp down, i think a fair few members would vote with their feet,
my personal opinion is that no one in any office should be allowed to book ot or do sa until every member in the office had be given the chance to increase their hours to 39 hours that way every member that wanted had got a full time wage, then look at who gets the overtime fairly
