hello. i have been a postman for nearly 4 years now, and on the same float as i started, which is 37 hours, but my contract is only 35. for the first two-years, they paid me for the 37 hours float that i did, no matter if i went home early in the week, but over the last year id say, if i go home say a hour early on a monday and a tuesday then they deduct me, i dont get the 2hours overtime, and i only get paid for my contract hours even though im covering a 37 hour job float, is this correct? there are also other boys in the office on say a 36 hour contract covering a 40hour week job, and the same for the they are getting decucted if they go home early in the week even though they are covering a 40hour job, any ideas if they can do this? cheers

I know its not an answer to your question, but why not force the issue in your favour (as in all of you doing regular hours above your contract), by all working together and saying you only want to do your contracted hours, but stating you will regularly do more for an increased written contract?

Your DOM is taking you all for fools, lapping up the extra work as and when required for your duties, but consequently you are not getting credit for this in your holiday or sick pay.

More directly regarding your question, is your DOM/lino officially authorising that you start earlier to start prep earlier? If so, that work is guranteed overtime pay above your contract, if you then finish delivery early (having not broke h&s or security protocol), it is up to your lino to find you work until your contracted finish time.

Be careful by suddenly refusing to work over your contracted hours, this could be deemed as unofficial industrial action, inform your manager in good time ie one week notice that you will performing your conditioned hours and no more.On the matter of covering a 40 hour duty you should get paid the full hour-age if not RM could be discriminating against you as a part timer.If the full time staff are going early and still getting paid for the 40 hours then see your rep and make representation, again you are being discriminated against.

So wanting to just work your contracted hours is unofficial industrial action?? I dont think it is. Ill work the hours im paid for then go home thank you very much and if that means i dont complete my delivery one day then tough....pass it over to management to sort that one out.

This is RM's very own words as stated in their Guide to handling industrial action.
Although it's more about 'working to rule' if he doesn't want docket,he doesn't have to do it.
WTR:
In this form of industrial action employees perform their duties SRICTLY in accordance with any laid down guidelines.This will be evidenced by a possible drop in performance from rigidly following guidelines or instructions and is likely to have the same result or lead to a go slow.
Obviously, it may be difficult to declare a WTR as industrial action as, by its very definition, it means people are working as they are supposed to.

just to clarify, you are saying you go home early and are deducted hours,

are you working 37 and only getting paid for 35?

or

contracted and paid for 35 but covering a 37 hour week shift and only working 35 hours due to finishing early but still wanting paid for 37 hours?

yeah, say if i work 35 hours, then i should be paid for 37 as the float is a 37 hour float, why not? thats what the jobs add upto, just beacause i get the work done and dont take my time chatting and having cups of tea here there and everywere like some people, and go home a hour necause i have got my head down and done my job done early should i be deducted? theres people going home a hour or more everyday on a 40 hour contract, and just because there on a 40 hour contract they cant have anything deducted off them, is this fair? or discrimination towards part time workers?

Is it unfair - in life probably.

In law - unlikely.

If your contract is for 35 hours and you are doing everything expected of you within the 35 hours would any other company pay you an extra 2 hours. The fact that FTimers have capacity within their working day to absorb another hour is for management to address and if they do there is nothing FTimers could do about it - except to work properly.

I am afraid from what you have posted you have fallen into the trap that those working for Royal Mail did back with Anal Leighton when he promoted job and finish. We back then, and you now, proved that the work can be done quicker and cheaper so why would Royal Mail pay you more than they can get away with. Its not fair and it does not generate loyalty but it is RMs way

My advice, if you want take your entitlement of breaks and work your contracted hours, they may then change their mind, but while you prove you can do a 37hr job in 35hrs they will continue to pay you 35hours.
