sickleave and bank holidays

ive been checking this one out on here but i still cant find a definate answer, a colleague was sick over christmas(covered by a note), and has been in today to see the dom to claim back the 3 days over christmas that we were off (25 sun, 26 mon, 27 tues.) the dom is adamant he does not get them back, and he,s been on the phone to the area rep, who agrees with the dom. saying he,s not entitled to them back. the lad is 100% certain you DO get them back. i told him ide ask on here. can anyone clarify please,,,,fish, clash, dingo, ANYONE. ta.

you wont get sick leave back just annual leave

This does need clarification though. If you don't buy extra leave when you start you get 4 weeks leave - as we work 5 days a week that amounts to 20 days leave a year - the minimum in law is 28 days leave a year http://www.direct.gov.uk/en/Employment/ ... G_10034642" onclick="window.open(this.href);return false; which can include the 8 days public holiday.

So as I see it Christmas Day and Boxing day are part of our statutory entitlement so I think he should be able to get them back -- Might be worth a call to ACAS.

If you were sick for the full leave year,as teebs pointed out you would be entitled to carry over your Statutory Entitlement of 28 days.
That means that there is an argument to say that in certain circumstances at least some of your Bank Holidays are part of your Statutory Entitlement.
Purchased leave doesn't count as it is effectively unpaid leave.
It would be complex and doesn't effect anyone with more than 28 days entitlement but if you were up for creating a nuisance of yourself i think you would have a case.
