i dont get the "compensation" bit.

if you win dont you get your "earnings" or "losses" back (subject to proving you were looking for work etc)

is compensation an award soley for being wrongfully dismissed?seperate from the loss?

the average payout is 6k
you get back pay etc if you are sucessful
you will get a 25% uplift if your protected characteristics have been breached


its all included in your statement of loss

the issue of 60 k awards is relative to your current salary, ie, airline pilot, solicitor etc

There is no average pay out. If the chairman and panel find in your favour there are calculations on statute which determine any award and compensation. If your case is bomb proof you may find "your" solicitor and RM solicitor arrive at a figure either through negotiation (or sometimes magic :wink: ) Tribunals are time consuming, stressfull and a hassle for both parties but if you know you're in the right and your employer aint then stick in. Your (union ?) solicitor will let you know if the case has a chance and if it is worth going to court. Good Luck.

Thers is no magic or a court its a tribunal. The average payout is around £6000 odd.

but what if you win and they dont take you back??
do you get your back pay then? and can that be then counted as "loss" so potentially reduced??

I thought you get two options. your job back with back pay. If they don't give you your job back you get a higher amount of Compo.

ok that was my understanding.

so if you get your job back and they take you back you get back pay plus a comensation amount
if you win but they dont take you back you get back pay plus comp.

have to ask about holiday pay in the second instance....

ive been sacked for 6 months and would have accrued hp in that time.
