Dismissal and Greivance
Hi Guys,
I have been dismissed this morning, for swearing, but's that's neither here nor there, but my question is thus:
I have lodged a Grievance, December last year, and I had a meeting arranged for the end of this week. But now I no longer work for the company, how does this affect my Grievance?
Will it still be heard? or is that it?
Perversely, the Grievance was lodged in December 2011 against the manager who dismissed me.

No, there were no witnesses, but i admitted i swore, not at him but within the context of a statement.
I told him i couldn't complete, and he said he'd put me on something i could complete, i told him he can do what he effing well wants.
As he walked off, he says " and I'll make you work your time", to which i said, " you can do what you effing well want "
Then i was suspended for swearing.
The Appeals lodged, just got to wait.
As for my Grievance.....well who knows.

It is highly unlikely you will be sacked. This is a personal opinion but i stand by it if thats all you did. You will Probably be left to sweat on full pay for a week.
Finally, i would be suprised if you have been dismissed. At the worse, precautionally suspended. (manager felt 'threatened'). A oxymoron.

We've had a guy sacked within the last few weeks for exactly the same thing.

Now, the point is, my dom swears like a trooper, and I believe you talk to people the way they like to talk to you. This is the same idiot who stopped my sick pay because he THOUGHT that my sick note was finished, hence the Grievance. there is other mitigation that I shall be using.
Oh, and it didn't help that my local CWU signed a statement when i rucked up in the fact finding. it's quite staggering!

Dismissal without notice usually only stands if the correct procedures have been followed leading up to that dismissal. An appeal/tribunal will also look at your 'two year serious' and what warnings you'd had leading up to the decision.
The use expletives towards your superior regardless of how they communicate with you is wrong as is 'rucking up' during an official procedure. I'd strongly suggest that you put those beliefs on the back burner if you wish to pursue an appeal/tribunal.
