ADVICE PLEASE,I HAD A HERNIA OPERATION IN JUNE LAST YEAR FOLLOWING A ACCIDENT AT WORK IN FACT ROYAL MAIL HAVE JUST PAID COMPENSATION,HAD SOME 6 WEEKS OFF,THIS RESULTED IN A STAGE 1 INTERVIEW BUT THE LINE MANAGER DID NOT ISSUE HE CITED ACCIDENT AT WORK.

SOME 2 WEEKS AGO I SAW MY GP REGARDING WORRIES ABOUT REAR END ISSUES,THE G.P. HAD A FEEL,AND REFERRED ME AS A N EMERGENCY TO THE HOSPITAL,A CONSULTANT PHONED ME WITHIN 3 DAYS HAD A CHAT AND INFORMED ME I WAS SHOWING SIGNS OF CANCER,HE TOLD ME I WOULD NEED TO GO FOR A PROPER LOOK WITH A CAMERA AS AN EMERGENCY.

I RECEIVED A CALL THE FOLLOWING WEDNESDAY TO GO IN NEXT DAY,I PHONED MY MANAGER TO REPORT THIS,I HAD THE PROCEDURE WHERE ABNORMALITIES WERE FOUND AND REMOVED AND AM STILL AWAITING BIOPSY RESULTS,I HAD TWO DAYS OFF ONE ON THE DAY AND THE DAY AFTER AS I NEEDED TO BE CLOSE THE BATHROOM.

THE CONSULTANT ALSO TOLD ME I NEED TO HAVE FURTHER PROCEDURE NEXT WEEK,I OFFERED TO USE HOLIDAYS BUT MANAGER TOLD ME IT WAS TOO LATE AND I WAS BOOKED SICK,WITHIN A WEEK I HAD AN INTERVIEW FOR STAGE 1 (HERNIA OP AND 2 DAYS FOR SCARE).

AT THE INTERVIEW WE EXPLAINE THE ABSENCES 1 FOR HERNIA REAPAIR AND THE 2 DAYS,I ASKED TO BE REFERRED TO ATOS AND EXPLAINED THAT I MAY HAVE BOWEL CANCER AND HAVE TO HAVE FURTHER INVESTIGATIONS,BUT AMAZING WITHIN 2 DAYS HE HAD ISSUED THE STAGE 1,INDEED HE NEVER EVEN REFERRED ME UNTIL AFTER HE HAD ISSUED THE STAGE.

Cancer is named under the Disability discrimnination Act, Contact
your Branch secretary ASAP, register a Grievance saying you are being discriminated because of your disability. Disability should not trigger a stage warning.
Stage one grievance after 5 days stage two after 28 days ET1 tribunal for disability discrimination

Cancer is only covered by the Equality Act from point of diagnosis.
With luck the OP will avoid that scenario but as for using it in an ET i'm afraid it's a non starter.
At the end of the day this is covered by the "mitigating circumstances" section of the attendance procedure.
If it isn't i would like to know what is.

Lets face it mitigating circumstances are not taken into account at a stage 1 , because this would mean the line manager would have to show independent descreasion and a back bone to stand up to the DIM. Both of which we know he does not have mate

ABSOLUTALLY DISPICABLE

I would strongly recommend you put this matter in the hands of the union and consentrate on getting your health sorted, you have more than enough to worry about set aside dealing with these arseholes!!!!!! Bowel cancer is very cureable when found in it's early stages, so try not to worry too much...... Get sorted soon my friend .......

I know they've given a stage 1 to someone who was having chemo so I doubt you've got a hope in hell of getting out of having a stage 1 for possibly having it. Bunch of heartless barstewards who are more concerned with how the figures look on paper than the well being of their staff. I've heard the DSM before telling his ASMs that more Stage warnings needed to be processed because it didn't look good that our sector had so many unissued for one reason or another It's supposed to be at the DOM's discretion, but clearly that's not true, because if they decide not to issue it, they get it in the neck from higher up so they therefore have no choice but to issue it do they?! Bloody farcical procedure.

Anyway, concentrate on what's important and that's getting yourself fit and healthy.

They issue them with the same stock answer....it's not that we don't believe your illness is genuine,it's just that you failed to maintain your attendance as agreed under the attendance procedure with your union
And there is no appeal for a stage 1 or stage 2.....what do you mean you want a grievance form, what for? Turds.
