Requested to work your break
I do 5hrs per day, which includes an ad-hoc 20min meal/tea break.
If I'm asked/requested to do work during the day, which means a break cannot then be taken, am I ok to leave 20mins earlier?
This isn't a "one off" by the way, regularly getting tasked with a workload that inhibits a break being taken during the first 4hrs 40mins.
Logically, this seems reasonable to my understanding, as if not, I'll end up giving 100 mins of work for Free per week.
Any comments welcomed.
Thanks everyone...

Re: Requested to work your break
We would get 30 mins for a 5 hour shift and the break must be taken during the shift and not at the beginning or the end. Law. Although some folks elect to take their break at the end if it suits them.

You are entitled to a break BY LAW.Thunderthighs wrote:I do 5hrs per day, which includes an ad-hoc 20min meal/tea break.

They can tell you when to take it but it should NOT be at the end of your duty!

Re: Requested to work your break
1.You have a right to a break.
2.That break should be as near as possible to the middle of your working day.
If you forgo number 2 it's very difficult to make a fuss over number 1.
The two things really have to go together if you want to make a stand otherwise you're kind of cutting your own throat.

Re: Requested to work your break
From the direct.gov webiste, the statutory rights to breaks
http://www.direct.gov.uk/en/Employment/ ... G_10029451" onclick="window.open(this.href);return false;
Rest breaks - a break during your working day
As an adult worker (over 18), you will normally have the right to a 20 minute rest break if you are expected to work more than six hours at a stretch.
A lunch or coffee break can count as your rest break. Additional breaks might be given by your contract of employment. There is no statutory right to 'smoking breaks'.
The requirements are:
•the break must be in one block
•it cannot be taken off one end of the working day - it must be somewhere in the middle
•you are allowed to spend it away from the place on your employer's premises where you work
•your employer can say when the break must be taken, as long as it meets these conditions

Re: Requested to work your break
5 hour shift= 30 minutes meal relief
If you do o/t on any given day, there's an extra 10 minutes entitlement at 7/9/11 etc. hours of work, regardless of what your contract is.

Since he/she only does 5 hrs all that is irrelevant.zx135 wrote:From the direct.gov webiste, the statutory rights to breaks

not quite irrelevant, look at it a slightly different way, as he/she only does 5 hours, legally RM CAN schedule the break at the beginning or end of the shift as the statutory rights only kick in after 6 hours

Re: Requested to work your break
None of that matters though because we have a collective agreement that states...
Breaks at the beginning or end of attendance
Where an attendance is provided with more than one break, the second break may be scheduled at the beginning or end, in which case attendance is not required solely for booking on or off. A single break should not be scheduled at the beginning or end of the attendance.

Re: Requested to work your break
All makes sense, but..gota get the "Man" to realise that Time Series Analysis/Work Method Study NOT just academic.
Thing is, the supplied workload is sometimes such that its impossible to take a break.
Ok, "impossible" too strong a word, but would unable me to finish/complete whats been tasked. hen you got the "Why did you..." talk later/next day.
Yes, they're being unreasonable/unrealistic, but if 1 person finishes, and your taking over, what do you do, leave the PHG Locked/unattended?
All that happens then is, theres an accumulation of crap for me tidy up, in less time...more presssure, leading to mistakes maybe?
Cant win...

Re: Requested to work your break
You need to look at this in another way, just like HCT walk holders who lock up the trolleys and carry weighty pouches to do loops far bigger than the 2/5/10 minutes security protocol, who know if they pushed the trolley round (or when locked complied to the security assessment of the walk) then the delivery span is too long for the duty.Thunderthighs wrote:All makes sense, but..gota get the "Man" to realise that Time Series Analysis/Work Method Study NOT just academic.

You have so many contract hours to fill doing work including taking your paid meal relief entitlement. If you want to finish at your contract finish time, then you need to inform management and ask them what they want to do with the workload that you feel cannot be done in your time. If you want to complete the workload by going past your contract time, inform management and get authorisation for the extension to the day.
