Accident Whilst delivering

I was out delivering today (20/1) doing my usual round i go into some flats,this idiot has his puppy running around in the close and when i opened the flat door the dog runs out and gets knocked over. I spoke to the DOM before leaving work today and have to speak to him again tomorrow in reference to what happened. The driver saw what happened, however my DOM been the complete useless idiot that he is - is more or less saying i should be more responsible and checks for dogs running around in every close to make sure this does not happen.....Is he having a laugh! Has anyone else been in a similar position and if so what was the outcome.?

Dreadful, but if people have dogs--they need to take resposibility for them I expect you feel bad enough about this, without unsymapathetic managers ! Good Luck.

Unfortunate, but you're not the owner of the dog and therefore not responsible for the dog's safety. What if someone else (a neighbour) had come in? Would they be liable for the dog? Or would it still be the stupid owner's fault for having his dog running loose?

However, did you also see the dog running loose before you entered? If so, why did you still enter? What if the dog had attacked you? Your safety is also still paramount...

It was an incident or a near-miss.
Has the dog done an Erica? If not - it didn't happen at all.

Take a look at the section I have highlighted in red, should that have been there? Was the dog running around in the Close? or was it loose inside the flats behind the door you opened?

We still don't have enough detail to make assumptions.

• Were the 'flats', behind the confines of that door, considered private property?
  If may be possible that the dog was only out of control in a public place due to the actions of the person opening the door. (Up until that point the dog was not in a public place)
• What method was used to enter the door?
  If the door was opened without official permission then the postman had no right of entry
  If a 'trades' button/key was used then it could be deemed that the tradesman was allowed to open the door, thus the owner had a responsibility to ensure that their animal was under control behind it.
