some info and help over stage 1 warning

Hi i had some time of sick over xmas i was sick from
20th dec to 24th i make that 4 days but they got me down for been of for 8 days till tue 27th so this takes me over the 14 days they say i did not call them on the 24th dec to let them no im back at work on the wed and last day sick was the sat but i no i did call them and got proof on my phone bill. also on my return to work interview they put down my last day sick as been the sat
the other time i was sick was jan 2011 1st week so thats very close to a year to.

how do you think i stand on this ?

my manager took great delight in telling me if i had phoned on a friday (my day off was the sat )to say i would be back on the monday i would have been under the designated days and it wouldnt have triggered a stage - this was mentioned at my stage 3 --( which got thrown out )

Interesting. Just had a Stage One myself. And was told that if I had called in on the Saturday and said that I would be fir for work on the Monday ; then the Stage would not have been triggered. Not best pleased.

As an aside. I have not had a 'Return to work' for the last one (which triggered the Stage) . Do I have any mileage on this?

1. Saturday 17th - The day you went sick.
2. Sunday 18th - (assumed since you were sick both the day before and the day after).
3. Monday 19th
4. Tuesday 20th
5. Wednesday 21st
6. Thursday 22nd
7. Friday 23rd
8. Saturday 24th - The day you rang in.
9. Sunday 15th - Christmas Day.
10. Monday 19th - Boxing Day
11. Tuesday 20th - Bank Holiday
12. Wednesday 21st - Return to Work

Had you not phoned in on Saturday it would have been eleven.

If they insist you did not ring in on Saturday they will owe you three days leave.

It's bullsh*t. If for instance you go back to work on a Monday the Sunday doesn't count as a sick day. It only counts if you continue off sick after the non-work days.

If you went straight back to work on the first working day after christmas then your last sick day was christmas eve (last working day).

Take the proof on your bill of the telephone call sounds like your DIM thinks you have pulled a fast one to have more time off and he wants to kick your balls.

Fight it although a stage one cant be thought until you get to a stage 3 but produce the evidence.

If a stage is issued put in a grievance not that it will do you any good as there not worth the paper they are written on.

It is 4 days sick did you tell them you were available to return straight away and as far as I knew RM runs from sunday to sunday so you would of had to declare yourself fit to return for the sunday. I know others have said this is B/S but many years ago this is how it worked.

Sounds like he classing the BH as sick aswell ask him to produce proof of your 8 days 20th-24th off sick, you ring in 24th say Im fit to return makes 4 days.

they are talking crap, unless you rang in christmas day to tell them you were still sick which you obviously didnt, then they must presume you are fit for work on that day

There is nothing to fight, they have been told that they have had eight days off, they have had eleven days off but because they phoned in correctly on Saturday it is counted as only eight.

BTW your edited dates of 20th to 24th do not total four days, they total five!
