if an individual has a long standing condition/complaint and royal mail have not followed or only partly followed medical advice from all medical people including ATOS over a long period of time, do you think that the individual would have a case suitable for a tribunal.

an employer does not have to take the opinion of its occupational health, but would be foolish not to

if an employer fails to take notice of an occupational health report, own doctors (gp) recomendations, DDA, etc
and it causes detriment to your condition, then you have grounds for action.

prior to any negative deterioration on your condition through the employers disregard for your health and safety, i would be putting in a grievance which has a time table of a month to be rectified, and will go above your Doms head.

what is your rep doing on this, IR as well as health and safety

In response to point four of your request, the line manager is responsible for the
workplace, his team and their health and safety. Advice from GP’s and Occupational Health
is highly important when making decisions regarding sick absence cases. Their advice
always informs the final decisions which are made by our management team

It is a known fact that your DOM is better qualified than any specialist, doctor or occuaptional health person etc as he has read the Junior Encyclopedia of Medicine(with real pictures!) :roll:
Royal Mail managers.....about as popular as a t.urd in a swimming pool!

latest regarding myself is that i'm to be assessed by an ATOS assessor and my DOM is saying that until i am that he does not know my capabilities , this is despite a file full of ATOS reports,doctors,specialists etc over the last 4 years or so. i've been taken off my delivery duty and am now basically doing indoor work which really aggrevates my condition due to the general immobility of the tasks. i was also placed on indoor duties without any assessment so its the usual case of rulings only applying when it suits. i'm very seriously considering taking royal mail to a tribunal regarding the way my condition has been handled

simple answer

by being given indoor duties,

are those duties sutable for your condition

has a RISK ASSESSMANT been done by the h&s rep and line manager

Anyone experienced with tribunals on here?
Got a quick question to ask which i dont want to alert any one involved in my case.Just incase they are stalking ;)
