Unfair dissmissal of Angard employee advice needed

Post by Joabdalla »

Hi , I need some advice on unfair dismal ! My husband has been working as a Xmas casual at our local sorting office and he was told last night half way through his shift that he was sacked !

After talking with angard today they advised that a regional manager would contact him in the next few days but to contact Royal mail HR in the meantime to log a complaint against the manager .

Can anyone help with the contact details please as I've searched the Internet and can't find anything !

Thank you

Being told " your sacked" then asked for a reason and he said " I don't need a reason , your casual I can do what I want I'm the manager" when another member of the team stood up and said " that's not fair he ain't done nothing wrong " he said if you don't shut up your sacked too . Just spoke to the receptionist at the sorting off and he said its not the first time they have had complaints against this particular manager . The fact my hubby has about 6 witnesses should help I think but the treatment of casual Xmas staff seems so unfair.

I'm totally sure about legislation etc but don't think you have a case for unfair dismissal. Even with witnesses. I could be totally wrong.

It would have to be based on discrimination...the legal terminology not the "he picked me because he doesn't like me" kind. :nervous

I would imagine the method is at fault but he could say he is no longer required as an agency worker. I don't believe it is fair but I don't think there is a case for unfair dismissal as he wasn't employed by RM in the first place..............despite the fact that Angard is a subsidiary. He should make a formal complaint though and if there is enough evidence from other complainants then it may stop him doing it again.

"My husband has been working as a Xmas casual" Probably not fair, but the clue is in your post...Was he sacked? was he let go/no longer required? what are his contract terms? xmas casuals are normally exactly that..xmas casuals. Good luck with finding something new if there is no redress

His contract was due to end in 3 days anyway !! But that's not the point ! Why are royal mail allowed to treat agency staff this way ?

As with all the staff at Xmas he's worked his back side off for the last 3 weeks
Agency staff are human beings not cattle that can be ordered off the premises just because this manager has little man syndrome !

Angard said his contract is with Royal mail and he needs to log a complaint with them and they directed us to to royal mail website for HR contact details . He won't even consider working there again anyway but the unfair treatment needs to be addressed here so that this can be investigated fully and if the allegations are founded he needs to be reprimanded .

Spoke to the receptionist and he confirmed he has been sacked .
His name has been taken off the sheet.

By the sounds of it after reading posts on here by agency workers they are being treated like slaves .

It's 2011 !!!!!!

My faith in royal mail has gone !!!

2011 means nothing, workers rights in this country are heading backwards - increased use of agency staff, large companies that think they can do as they please and a populace that thinks it's fine / I'm just lucky I've got a job! Nobody gives a s**t and nobody takes a stand - it will not get better any time soon.

My faith in RM went, ooh, many many years ago. Arrogant bullying management (as you now know) is still rife, despite the chiefs claiming otherwise.

Hope you do have a case, twats like that manager need a swift kick.

Unfortunately as a temp there will be little chance of any claim for unfair dissmissal. Although the way the manager said "you are sack" and not "you are now surplus to requirements" seems to be a little man on an ego trip to me. The fact he did this in a public area and then threatened another temp as well just goes to prove the mentality of this person. I do not think a complaint to Angard will do much either as being owned by RM they will have little intrest in following any complaint up.

It is just a pity RM seem to now hold the same contempt for all its work force be it full time , part time or temp as this manager has shown. All i can say is i hope the future is better for you two and you find a better employer in your next jobs

No point in pursuing unfair dismissal, as you have to work for an employer for at least a year to bring a claim.
But your husband should make a complaint against the manager concerned, and the totally inappropriate manner in which your husband was treated, and the threatening way in which the witnessing staff member was spoken to.
If we don't stand up to these bullies, they will continue to act in this way.
Good luck anyway.

In my past dealings with RM the CMA conduct code did state "bullying and harassment are tolerated at royal mail" I guess they still use the same code of conduct when the company falls out with workers. Count yourself lucky you did not get ill health retirement or you may have seen something that made you go like this.

Employee Health Service Advise = a reptilian experience
"you ever get that far, you never know what you might see"
"the contracts so good it should be made illegal"
"you have no idea who it is you are dealing with"RM
"is it the clour of my skin ?" WTF

I believe you've gotta be employed for a year (although it's changing to 2 years) before any employment rights kick in, unless it's on grounds of discrimination. I would definitely put a complaint in against the manager in question here, definitely sounds like he's got wee man syndrome. A common ailment among RM management.

Probably should have done what one Angard worker did when he got sacked and not been paid, he went in with 2 of his mates and battered the manager as was mentioned in one thread.

Probably not legal but would make you feel better and the Manager will learn to treat people like human beings.
