length of stage 2

Post by artisan »

Ive been invited for interview for a stage 3 that i think has been incorrectly triggered, i was issued a stage 2 and in the next following 12 months i only incurred one absence of 3 days, i had other absences but they were authorised special leave, in the 14th month after the s2 was issued i was ill again and off for 3 days, am i right in thinking that i should of been reverted back to a s1 after the 12 months? I have been told that because i was off just before the 12 months was up that the six month period extends beyond the 12 months and therefore my second absence in the 14th month makes that 2 absences in a six month period? Surley this cant be right, in theory you could be on a stage 2 for 18 months if you had 1 day off at the end of the 12th month, advice greatly appreciated, not the best thing to happen just before christmas

If your dates are correct you should have been removed entirely from the attendance procedure after 12 months.

http://www.whatdotheyknow.com/request/7 ... cedure.pdf" onclick="window.open(this.href);return false;
2. MINIMUM NATIONAL ATTENDANCE STANDARDS - EMPLOYEES NOT ON TRIAL
Employees who have successfully completed their trial period are still required to
maintain a high standard of attendance. Attendance may be regarded as
warranting formal action if an employee who is not on trial has:
Stage 1: 4 absences or 14 days in a 12 month period
Stage 2: 2 absences or 10 days in any 6 month period during the next 12 months
Stage 3: 2 absences or 10 days in any 6 month period during the next 12 months
1 absence of 4 days or less will mean removal from the procedure
The usual reasons for discrepancies are..

1.Date of issue of stage wrong.
2.Authorised absence wrongly reported as sick or unauthorised.
3.General management incompetance.

Take your pick. :whistle

Get your sick record from Sheffield, don't let them fob you off saying you can't have it.

well then your rep should have your attendance record 48 hours prior to the attendance inerview

you do not ask for the record

royal mail must provided it as stated, 48 hours before any attendance hearing

Its your own records, so you can have them,

HR may say that's an SAR request, but its not for your own sick records. Very helpful when I rang them once, suprising as its an RM department, but then it is data protection services.

For an SAR request just for info, (£10 still I believe)

here is the RM department,

Data Protection Act Services ,PO Box 341 ,ALDERSHOT ,GU11 1WW tel 01252 806513

I have a copy of my report which was given to me at the same time as the consent form to release my medical records, i dont mind sharing as i need advice because my union rep is backing the managers opinion on this, it reads as follows:

Stage 2 issued on 23/09/2010
Part day absence on 11/11/2010 ( no days lost)
3 days absence on 13/06/2011

Stage 2 should of expired or reverted on 23/09/2011 ( my opinion)

3 days absence on 27/11/2011

My argument is that my stage 2 should of cleared or reverted to a 1 on 23/09/2011, therefore my absence on 23/11 should of not triggered a warning, they are saying that it doesnt matter about the 12 months but that i have incurred two sickness in a six month period, i hope that ive explained this properly, this whole thing is making me ill....

A SAR OR DSAR IS A

data subject access request

as stated it costs £10 and the data holder has 40 days to comply. the data holder must release all information it holds on you including any manual intervention.

but in your case this is irrelevant as royal mail have to produce this data at no cost (attendance record) as it is subject to a disciplinary proceedure and must be made avaliable 48 hours before the disciplinary hearing

Stage 2 issued on 23/09/2010
When was it triggered, what is the date of the sickness that triggered it.
Many reports on the site of OPG coming back off sick and warnings given months later.
I Wrote-During Covid-Which is still relevant now
It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

From what i can see they are wrong, you had 1 sickness in the 12 month period during your stage warning.
Yes you had 2 in 6 months but the 2nd one was outside the 12 month period.

Strange though, these are triggered by computer and not managers, how did it come up is the question.

If it was issued on 23/09/2010.
If you have only had 1 absence totalling 3 days in 12 months it expired on 23/09/2011.
There is no "roll on period".
If there was you might as well tear up the attendance procedure...it would be pointless.
Ask to see this agreement containing the "roll on period".
Ask for everything they have on both your stage 1 and stage 2.
Ask your rep for the area rep's number.

if you incure no more than 1 absence of 4 days or less during the next 12 months you will be removed from the proceedure ( removed not stage 1 ! ) as a part absence is usually discounted i would argue your not on any stage !! :cuppa
