Part Timer on Full Time Duty Permanently?

Post by BernardBresslaw »

Hi,

I am currently a part timer on a 30 hour contract and recently, in our office, some full time 40 hour rounds were put up for pick. I applied and was successful and have been working on said full time round for the last 6 weeks or so.

My manager promised that my hours would be increased contractually, but he continues to make excuses, leaving me to claim overtime every day for the extra 10 hours a week I should be getting. This obviously does not help me with holidays etc and either way, he promised me an increase in hours, and as technically I am doing a 40 hour rural duty I want this increase sorted.

My question is, how do I go about putting some pressure on said manager to keep his promise. I am a member of the CWU - should I be getting an area rep on the case, as my own local rep seems to not be able to help.

Any tips most appreciated.

Most effective way of getting anything sorted in this company is to cut off everyday. Just work your thirty hours as contracted, let the manager deal with the headache of covering the ten hours per week every week. Chances are youll get made up to 40 as promised.

I've never understood this full time/part time walks. Surely if all walks are equal then anyone can apply for any duty it's just the ips times that are altered for either a full timer or part timer. If such things exist as a full time and part time walk then it's no use having seniority for any re pick as a full timer couldn't pick a part timers walk and vice versa. Who decides which is a full time or part time walk anyway?

Rurals are longer than towns, in my office the rurals only prep and deliver (and they are all FT duties) but the PT duties are all town deliveries and a re much shorter.

This is the case. I don't really want to cut off every day as it really is cutting off my nose to spite my face, as I lose the extra pay I would be getting by claiming the OT. Nobody else went for said duty, which is why I as a part-timer was lucky. However my manager said beforehand that any part timer successful in claiming a FT round would have his/her hours made up - this is all I am requesting.

I'm sure I have read elsewhere, that if you do overtime every week for a set number of weeks, they are obligated to increase your contractual hours to accommodate this, and as this will be a regular thing in my case, I am only asking for what I was promised.

Get onto the area rep, your local rep seems either lazy or stooopid,it's a no brainer...
You have signed for a FT duty you are FT end of.

not in my office, a PT who signs for a FT duty doesn't get their contract upgraded but has to sign OT for the balance between the hours. This has been raised up the levels but because we're over here we don't get any joy.

Thanks postman

That'd be me then

Laziness is all over our office starting with our managers and spineless blind dom

He did promise to increase hours and has requested a meeting with me
He initially promised a permanent ft positional increase but it now seems likely he will offer a temporary full time contract.

He knows if the op refuses this someone else on 20/30 hours will snap his arm off for the job.

If the individual takes out a Grievance, or the Rep goes to disagreement, I believe the correct situation is that the duty cannot be re-advertised until the current issue is resolved.

wait until you have completed the extra hours for 12 weeks. I believe that employment law states that 12 weeks is the point that the situation changes from being temporary to permanent/ongoing. Then get your rep to assist you.

Contract Law is a nightmare. I found myself in a similar position some time ago. Grievances and tribunals are stressfull and a pain in the ass ! ! ! Approach your manager or get a high ranking union official onside and put your case to Royal Mail. If all fails, ride the wave and keep claiming the O/T while it's there ! Tribunal Test Cases similar to yours (and mine) (apparently) favour the employer (my solicitor informed me). I'm not 100% convinced! Look up the meaning of "Duty" in your dictionary ! ! ! If you want to dig your heels in, dig deep and go for it. Good Luck brother.

When you signed for the full time duty was on a temp or specific event basis? if you signed full time long term contract then you are full time. The issue over 12 weeks is not correct. I believe that the 12 weeks refers to agency workers gaining The same basic employment Conditions. To increase your hours both you (CWU) and RM must agree.

Unfortunately nothing has been 'signed' as such. Duties were advertised, and the only proof I have even got, is the advertisement put up in the office which announced the successful applicants for each round. Said manager informed me that my contract would be increased from a specific date, which has passed, to take into account that duties have to run for 12 months i.e. 12 months since our office revision.

Thanks for the feedback so far. Much appreciated.

Does the notice say part time to full time on a temporary basis or on a permanent long term basis? If the advert does not state either then what have previous adverts led to? I.e. Contracts on a permanent basis. If so you could use this as custom and practice because RM have not informed staff of the change in recruiting to full time. Your rep should be able to help if not ask your Branch Secretary who will investigate.
