ive done three with simpson and miller at a tribunal

i take it we are talking of an ET1 CLAIM

why is simpson and miller not doing this ET claim for you

I've done 36. All were pulled at the last minute due to RM conceding they were wrong. You don't need to go through the CWU and can fill them out on line. What are you claiming?

31 for the same issue, put in individually and finally dealt with as a single complaint and a further 5 all unrelated.

I might add that they were all genuine and the we had tried the grievance procedure, but were frustrated at every turn.

The CWU has a panel of ET speicalists who do most tribunal cases , they rarely use solicitors. The Panel consists of some current reps and some retired members who have been on courses and been involved in tribunals for some years. The CWU send out the bundle to a panel member who reviews the case , the criteria is normally does it stand more than a 50% chance of winning in the experience of the both CWU HQs and the panel members. If it does than normally the indivdual will be reprsented if not then they will not be .

The exception to this is if there is a dispute in an office over the sacking and then normally the CWU will reprsent and often bring in solictiors or barristers.

Now tribunal law is complex and some claims can go to pre hearings where a chairman will advise that if the case continues then the indivdual could be liable for costs.

Equally the Con Dems are proposing a fee for indivduals who wish to take the employer to a tribunal which is another attack on working people

No. The largest group of 31 claims, were conceded a week before it went to hearing and all the cases were dealt with shortly after the DOM received notification of the ET. I dealt with them all myself as it takse forever to get HQ to do anything.

That will be the last you hear from ACAS until just before the Tribunal hearing and then they will try and work out a "deal" between you and RM.

That will be the last you hear from ACAS until just before the Tribunal hearing and then they will try and work out a "deal" between you and RM.

Not quite, If he is dealing with the case himself, he will get a call from RM solicitors requesting information and documents to support the claim and he may get a call from ACAS offering mediation.

Have you had a date set for the hearing? The respondent (Royal Mail) will also get a copy of the Notice of a Claim.
