I was told by a relieable source that IF a company wants to change your start hours they have to give the following notice

1 MONTH - If you accept the changes

90 DAYS - If you dissagree with the changes

Lets all put in a letter of dissagreement

At the very least it will buy you 90 days........

I have not received any letter stating that my starting time has changed. I do not go to WTL sessions as mine are scheduled for when the LM's are in the canteen for breakfast. There is so much 'bullsh*t' on the wall I don't have time in my shift to hunt the relevant paper work down. So I will be starting at my normal time of 5am.

According to my DUM RM sent the notification letter to the CWU so they don't have to send us one individually (another case of using the letter of the law to undermine the spirit of the law me thinks :sad: ).

The 90 days notice is legal,i've been involved in it before.

Summin must of gone on as the CWU,i think,have not mentioned this so far.
Chances are they have notified the CWU,which,thinking about it they have as it's in the talks.

Legaly your contract of employment is deemed to be the task you usually perform at the times you usually perform it.By law any substantive change to such contract can only be implemented with your specific , or your workplace repesentatives agreement. The CWU must have a legal department/ advisor Who should be informing us of these facts.

Dismisal, occuring from any failure to comply with any such unagreed changes to your contract of employment would legally be regarded as '' constructive dismisal", and under tribunal warrant a compensation payment

I certainly don't.
But the point I was making was that if RM claims that it is sufficient to give notice to the CWU
that means they are not giving notice to their most ardent a***lickers. so is it legal?

In our branch - all Reps put in disag letter - which I understand is at stage 3 level. Notices went up - I put in disag re 'Executive Action'. They were taken down. I was told that a letter would be sent to all posties - disag letter in - they weren't sent. The next idea - was a general letter - referring us to a local one on our notice-board. Disag in - no letter - no notice board! I am off sick with a trapped nerve in back - but it constant touch with my unit. My DUM tells me this morning that he has orders to implement later starts - next week. Why - Oh Why - do we always seem to be fighting these issues at unit - or at best - branch level? :arrrghhh :arrrghhh :arrrghhh

Coz at HQ they miss the point... Not enough COMMUNICATION between the ranks... Now Area should be more active in my book as well... Now the talks are finished and RM are forcing us OUT we have 2 keep our Disag going in locally but with plenty of back up and guildance... Its said the Rep is only as good as the people behind him/her and most of this is true... There has to be a two way street. Info from Branch and ready front line troops..

Fair point, Iwas just enjoying a period of uncalm. :Very Happy . Not sure of all the legal in's and out's.

The bit I am sure of is that these proposed changes constitute an alteration in our contract of employment which requires our AGREEMENT before they can be implemented , that is the law.

RM can give ten years notice if they want, but unless we AGREE to sign our hard won terms away,I think there will be numerous court cases, or one big one if the CWU fight this legally :Very Happy

Sample 318's for duties starting on the 17th of September have been up in our office for about 3 weeks now. I asked the union rep a couple of weeks ago if they were official notice so that could bring the changes in on time and he said that even if they were they were well within their right to put them up.

It does look like RM had this planned for some time or, at least as a backup plan. I hope our union also carried on with its plans over the last 4 weeks.

Ive heard many times on here that the 318's (old) wernt avalible to see... Little blur walk books gone and that posties didnt have a 318 anymore... Funny now that In spedley's office there is a NEW LOT OF 318's WOW come back from the dead just like jesus!!!
