does anyone know if your dom can withhold your overtime payment as this seems to be done on a regular bases in our office ? i am sure he can not but could do with clarification please.

Ever thought of not doing overtime? Just do it for a few weeks, then watch them beg you to do it.Then all of a sudden you'll have no problem with your wage's...The reason I suspect your wages are being withheld is, there trying to keep the overtime, under budget for the office= bonus for themselves.

i dont do any overtime but others in my office do so was looking for answers when i go in to see the dom on monday about it

I read somewhere on here that they cant just scratch your o/t claims without explanation and if they do they should be taking you down the conduct code for fraudulent claims. I suppose its another of their 'wheezes' to make sure that the o/t doesnt go over budget one week and they wait for you to notice non-payment and complain so they pay you during a week where they have more budget to spare. Of course if it carrys on over weeks and you forget to claim altogether then that is an added bonus (to theirs).

So presumeably a "belated" overtime claim is being added to the overtime docket by each postie on the first work day after seeing their weekly payslip, which is increasing in size each week?

Probably because they NEED the money as they are only contracted part-time hours. They are entitled to claim the overtime as it is necessary to complete their duty. Quite often working over their contracted hours is the only way for some colleagues to earn a living wage. We are not all lucky enough to be getting paid full time wages but only working part-time hours as most of my colleagues do.

If management do not pay this overtime then they are breaking the law.

when you book overtime on the 552, a mangager will need to tell you there and then if he is not going to pay it, and give an explanation. if you are unhappy with the answer, do a grievance and a 7 day letter before action.
if it is not paid within 7 days, you will issue an ET1 claim form under section 13 of the employment rights act, unlawfull deduction of wages.

(there is no 12 month qualifying period on this)

if he uses the excuse of you finished early say on tuesday, tell him there is no provision under the 2007 pay and mod agreement to bank hours, and that is what he is doing
