went with a member to a stage 1 today. asked for a atos referal as his condition might come under equality act, so we should await the report to make an informed decision on weather to issue the stage or not. manager agreed to referal but issued stage their and then, and told me to be quite as i'm only here to observe. we walked out, and have reported him to his superior. considering grievance procedure. any other idea's on what to do about this tosser.

they can issue the stage against your colleague as with ATOS its only advice. unless ATOS say your swinging the lead, then they believe them.

still, file a grievence. it proves you never agreed, do not sign anything.

not much you can do, the system is wired that way until dismissal.

Absences which are disability-related may be counted where it is justifiable to do so and in these circumstances the employee should be given advance warning that future absences will no longer be discounted.

Obviously he wasn't given advance warning so obviously he won't be accepting the stage.

worth investigating the possibility of taking the employer to an employment tribunal if you feel hard done by on the disability front ?

the employer has to make "reasonable adjustment(s)" to "the way you work" and if no reasonable adjustment(s) have been made
[e.g - perhaps - time off for dealing with the disability or issues relating to the disability i.e treatment)

minefield but worth investigating - pronto - as very strict time limits apply

that is incorrect

you are there to represent the member in an official capacity

i hope this issue has gone to area or a central committe meeting for discussion

the said manager has been told to await atos report before he makes his decision, and his immediate superior has told me he is to get refresher training on the attendance procedure. thanks for all the help. he's been made to look the idiot he is.
