Meal relief on your round

We have been told by our DOM that we must take 20 minutes of our meal relief before we go out and the rest whilst we are out delivering on P+L.

Can somebody confirm that he cannot force you to take a meal relief in your van?

Personally i think we should take all 40 mins before we go out.

he can tell you when to take it just not where, he is allowed to break it down as long as you get at least 1 continous 20 munte break if your working for 6 hours or more so 20+20 or 10+20+10 are legal but 10+10+10+10 would not be, personall would be telling him if he is insisting you take it on part of your delivery you will be driving back to the office to do so

why dont you take it at the end of your delivery like everyone does?

I would but the DOM is not so keen for some reason

ask the clown if he has prepared your toilet and handwashing facilities and your rest room some where on your route and when he stares at you blankly tell the idiot that until such facilities are in place on your route you will have to return to the office for your break.
our dim tried this with me 5 years ago and ran for cover when my rep asked these questions.
an employer must provde these facilities for employees BY LAW.

A few years ago, I remember a rep (on a rural ) arguing with management about how far off route he could go to have his M/R.
I forget the outcome .

They won't because unless it's been agreed by a revision any decent office would kick up a stink but legally speaking...they can....period or otherwise.

QUICK QUESTION THEN ON THIS

if a delivery office have allways taken there 40 minute meal relief before they go out then royal mail cannot demand you now take a 20-20 minute break

the contract of employment states a 40 minute break, that is correct but with reference the above

if you allways took your 40 minute break prior to departure then custom and practice comes into the equation, that then comes an implied term into your contract of employment and by royal mail demanding a 20-20 break would be in violation of your contract of employment. you could then if you want sue royal mail

this would then be seen as a breach of trust and allow you to claim constructive dismissal

THE ONLY WAY TO ALTER THE ABOVE WOULD BE VIA A LOCAL AGREEMENT.

LOCAL AGREEMENTS WOULD OVERIDE STATUTE PROVISSION

It would be difficult Keith especially when the standing collective agreement on meal relief cites 20/20 as a possible pattern.

The important thing though is that changes to meal relief patterns should,like any other changes be agreed preferably as part of a revision after a vote from members.
If they aren't....use the IR framework...use rule 13...go to war.

have always taken meal relief at end of my duty. we now start at 7am at 9.20am managers tell us to take a break for 25 mins. (no canteen, just coffee machine) the rest during or after you finish, a few of us take our breaks the other idiots work through them( gaffers love them) CAN THEY FORCE YOU TO SPLIT IT UP, I'D RATHER TAKE THE WHOLE 40 MINS. what about when on delivery and know toilets or hand washing facilities ?
