Hi there,
One of my colleagues was on rehab duty after a period off with stress.
The rehab letter stated mon-fri, but the DOM wanted him in on a rotating day off and fooled him into coming in an hour early for the first week.
When he questioned the DOM about it he was told to stop playing games and ended up having two managers in the office with him and no witness.
He went off sick again after showing them the rehab letter and they said it's wrong.
Now he has an appointment with ATOS and the DSM in a week or so, and he's received a letter from DOM inviting him for Stage 2 interview on that day.
Can he refuse the stage 2 interview while he's off sick?

You can still be progressed through the attendance procedure while off sick.
8. STAFF ON SICK LEAVE
Where an employee is off sick and cannot attend for interview at any of the formal stages, he/she will be given the opportunity to put forward his/her case in writing, within 7 days, and would be free to enlist support from the relevant union representative for that location or a friend from the same location in drafting his/her case for submission. If the opportunity is declined, the case would be processed in the normal way.

Bascially to cut it short he's getting a stage 2 so he better get used to not going sick for the next year

4. Limited progress may be due to overestimating an individual's capability given the employee's physical/ psychological state and/or inappropriate job or hours of work. The rehabilitation period may require adjustments to job content or hours of attendance in the light of experience and EHS recommendations or a gradual build up may be incorporated in the initial rehabilitation plan and adjusted if necessary according to progress.
