IHR With Lump Sum

Hi, i am about to be ill health retired and go in to meet my DCM tomorrow. i suffered heart failure last xmas and have been off since and my illness is ongoing, however as i'm only 38 they thought it was a bit early to get the pension etc, i just need assuring of what i am entitled to and what sort of questions to ask/put forward as i am not going to let myself short. Any help is gratefully appreciated. I am with Parcelforce as a delivery/driver and would have been with them for 4 years in october

It is rather unfortunate given your length of service that you would not be given an enchanced Pension even if it were on the table. All you get is the 4 years Pension you have accrued.

Therefore, it is probably in your best interests to get the IHR with Lump Sum which the firm is offering. The agreement covers all of the RM Group so it would be 34 weeks plus 9 weeks notice and outstanding leave at the point of termination . The only Tax/NI that is applicable is on the outstanding leave .

Your Pension will be frozen until 65 or available earlier with a penalty.

If you want to finish I would say a limited amount however if you want to stay in the business , I would take a Rep ( if a Member) and fight your corner.

Questions like...

What other work can the business offered me ?
What is the timescale for a potential recovery in your health ? If it is a case of less than 6-9 months they shouldn't finish you.

You should be covered under the old DDA (Equality Act ) .

I think it really depends if you WANT to finish , and how long will a recovery take ?

Thanks, i have no option but to take it as my health comes first and my consultant has already told me there is no chance of me going back by april which is 9months however if i have a transplant, which is a possibilty, i could be stronger than i've ever been. so 43 weeks tax free lump sum and outstanding leave??

Yes..That's correct. Had your service been longer I'm pretty sure that given your condition and likely prognosis, the argument for an immediate Pension is one that could have been won.

However, given your service of 4 years the Payments would it be worth it compared with 34 weeks pay ? I would definetely ask your boss to consult with the Pension Helpdesk and ask them what the Pension would be before considering your next move.

Do that before agreeing to anything else... 4 Years Pension v 34 Weeks Pay. The notice period is paid whatever option you take.
