Where do I stand?

Hi everyone, looking for some advice here! My driver who delivers my bulky parcels was bitten by a dog on my round. The owner of the dog called him a liar, he told her that her dog had bit him, she told him "my dog doesnt bite", showed him that marks and she accused him of scratching himself and making it bleed. She then phoned the police and acused him of abusive by shoutig and wearing at him. My driver got lifted by the police and charged with an offence. All this when she had no witnesses but managed to get some junkies to say they witnessed the offence. What worries me is if I have a parcel that has to be signed for and the dog goes for me. can I now refuse to deliver to that address? Any info or ideas are more than welcome

Tell your boss. Refuse to deliver anything else. Done this myself before.

The dm never even mentioned it to me, came from my parcel delivery driver himself. Driver was told that job would be safe, but with a conviction for something he hasnt done, will stop him from moving up the ladder, is it going to come to the point to cover ourself that we will have to go out in pairs? Their word against ours about mad dogs attacking!

Firstly, if possible get Doctor to confirm these are dog bites.(And I hope he has had them seen to,even a small scratch-wound can become badly infected) I can only say if it was me I would take out a private prosecurion against this lady!

You can refuse to deliver to the property if you feel the dog is dangerous. The driver should get the bite looked at by the hospital and get a report saying that it is a dog bite. The woman has clearly committed perjury as have her "witnesses" and this should be reported to the police. If the driver has been already charged then CPS will take into account the validity of the woman and the witnesses and throw the case out. Tell the drive not to accept an " on the spot fine " if that is issued and get the unions legal department involved ASAP.

Correct its not perjury until they do it in a Court of Law. However, it is Perverting the Court of Justice which can be punished by a custodial sentence.

Wasting Police Time - section 5(2) Criminal Law Act 1967
(Archbold 28-224)

The offence of wasting police time is committed when a person:

causes any wasteful employment of the police by
knowingly making to any person a false report orally or in writing tending to: show that an offence has been committed; or,
give rise to apprehension for the safety of any persons or property; or, show that he has information material to any police inquiry.

the day is not far away when i feel we have to wear video recorders to monitor our every move. to many people have been accused for crimes they havent commited ranging from personal attacks to sexual. weather royal mail will invest in giving everyone one remains to be seen but would be a positive step

Is it legal to do so? I know you can get cameras small enough, but where would we stand legally if we recorded everything we see on our rounds?

Just refuse to deliver it if you know the dogs bite. If you got bitten get it on record with medicial evidence.

If you are in public or in a place open to the public (bar, restaurant, mall, etc.) you can be filmed, as there is no expectation of privacy.
Private property is a different matter. As to filming someone on their own property from the street, ive no idea.
