A postman I know has just been given a blameworthy on their record:-

They were driving down a lane when another vehicle came too wide round a bend, to avoid a head on collision they went up on the verge and caused a bit of denting to the sills and a scratch to a brand new van, they had the normal factfinding interview and they have been told they'll get a blameworthy because they were driving the van....simple as.

This particular postie has not shown their driving licence for over 2 years due to various reasons, sent away for change of address, to get points wiped off etc etc so my question is this..............

They've asked them for a copy of their driving licence asap, i'm guessing to cover their own asses because from what I can read into this they shouldn't have been put on driving duties without them seeing the licence, should they?, so what should their next move be?

They have recently moved house and their licence needs to go back to DVLA for a change of address, it may well already have gone..........I don't see the postie at fault here because without seeing their licence surely they shouldn't have been put on any duties that involved driving?

Could management be up s**t creek without a paddle here or what do you guys think?

They've asked the postie for their licence at every 6 month driving licence check but it's never been available, and then they've just let them carry on as normal.....is that right?

The postie has also been told to ring their insurance company and advise them what has happened, seems strange also?

- and what if he hasn't got an insurance company because he can't afford a car on these wages ?

The postie has also been told to ring their insurance company and advise them what has happened, seems strange also?

you are supposed to notify your vehicle insurer if you have an accident, even if its on a works or borrowed vehicle.

no, its only if you have an accident.

when you insure your car they ask if you have been involved in an accident in the last 5 years, at the time the answer may have been no, but circumstances change and insurers like to know.

RM are supposed to check EVERY drivers license every 6months at a minimum.

Well you should let your insurers know but.... what if someone drives a RM van but doesn't have thier own car and so no insurance? :hmmmm

As you are covered under RM insurance for accidents while driving an RM van they should deal with any claims, so technically you shouldn't need to bother your own insurers. I wouldn't tell my insurers unless there was a likelyhood of a third party claiming against me as it's too much hassle getting your full ncb back after things are settled!

If the Driver doesn't have a vehicle of his/her own, and therefore no insurance in his/her name. Then there's no need to contact anyone else. If however, he/she DOES have a vehicle, then he/she MUST inform his/her insurance company. Because he/she has been found (however unjustly) to have been responsible for an accident. Which could potentially affect that policy. If you don't tell the insurance company, and they find out later. It could potentially, invalidate your insurance! :shock:

If RM are demanding to see his/her license, and it hasn't already been sent off. He/she can go in person, to DVLA Swansea, to put in an application for the updated license (new address, removed points, etc.), and it will arrive through the post in 2-3 days. I had to do that once, several years ago, when I lost the paper part of my license, and I'd been pulled over for a vehicle check. I never carry my documents in the car, and didn't realise the paper bit had gone missing, so it was the only way to fix it in the 7 days I had. If the Police can give us 7 days, the RM should too. :hmmmm

Oh, in case you're thinking it's too far to travel. It took me nearly 5 hours each way, when I had to do it.

the police will extend to 28 days if you explain the circumstances andy.

I think you will find that you are supposed to inform your insurer (if you have one) if you have ANY accident, regardless of fault.

The more important part of this was to establish if management were in the s**t because they allowed the postie to drive without seeing their licence?

I agree, there's no way I'd ring my insurance company if this had happened to me, not a chance!

If they find out later (during a claim YOU may have) you'll be screwed so be careful.

Your manager is supposed to ask you to show your license every 6 months,if you fail to do so then your manager should take you off driving until you comply,if your manager has failed on 1 account already then i would be arguing as to how and why he/she can give a blameworthy when they themselves have failed to comply with Royal Fails own procedure?As a rep i would be banging a few tables and asking how Moya would feel that another 1 of her managers is failing to do the job,it is a requirement under our O license to follow this procedure.
