i,ve emailed my branch bout this and i,m just waiting for their reply, so i thought i,d ask on here also. last year i was off for 5 month with osteoarthris of the knee. i was covered under dda, but they went ahead and issued the stage 1 regardless, ignoring dda rulings. my stage 1 'sentence' is due to run out in december. anyways, i,ve been given a date for a hospital admission for a total knee replacement, and the consultant says i,ll be in dock for 3 or 4 days then off work for at least 3 months. so i,ll be going sick again from august 12th. this upcoming absence will trigger a stage 2.... if i,m off work til AFTER the expiry date of my current stage 1, does this mean they can only re-issue it as a stage 1. OR, can they give a stage 2, as it occurred DURING my stage 1 'probationary' period. i know they should,nt be issuing a stage full stop, because of the circumstances. but we all know what uncompassionate could,nt care less scumbags they are. any knowledgeable answers most welcome :Very Happy

The unreasoble bollox apart.
It's when you trigger the stage that counts not when it's issued so it will trigger a stage 2.

cheers fish, i thought as much. its a bit of a paradox that is, cos come the interview/issue date, i wont be on any stages. hopefully the area rep who is going to deal with it, will stick it rrrrright up them!! :nana

interesting reply off the area sub rep, the area rep and branch secretary are both on annual leave, but he says they will issue a 'stage 2 triggered' warning, but by the time the interview comes up, if my existing stage has expired (which it will have done) they can only issue a stage 1. having said that, he also says if i,m covered by dda there should be no problems. but THAT didnt bother them when they issued the stage 1. i,ll have to wait and see.

I think your Area Sub Rep is wrong davey. :neutral:

The attendance procedure even allows for you to be staged while you are still off sick although it's unusual in my experience.
8. STAFF ON SICK LEAVE

Where an employee is off sick and cannot attend for interview at any of the formal stages, he/she will be given the opportunity to put forward his/her case in writing, within 7 days, and would be free to enlist support from the relevant union representative for that location or a friend from the same location in drafting his/her case for submission. If the opportunity is declined, the case would be processed in the normal way.

When you were issused with the stage 1 did you ever think to take out a grievance against the manger as you are covered under dda and get the stage 1 withdrawn.
Also if you are covered by dda and go off for an operation that will correct the problem you should not be issued with another warning unless your manager is a prat and your rep does not put up a fight to stop it.

they once staged me when i was bitten by a dog on delivery (bout 10 years ago) i was told i could not appeal against it as the decision is final, but i could AND did put a grievance in. it went on for months and months until eventually and conveniently ALL the paperwork was mislaid. the case was then dropped on union advice as the stage had expired. so in my view grievances are a total waste of time and effort. and i can guarantee they WILL try to issue another stage, cos this dom is an utter c***. they have no respect for the workforce or dda.

Had a stage 2 interview last week. I`d been off since march following a transplant, the lino didnt issue as he said it comes under dda and the transplant was a positive step towards improving my attendance.
All managers are instructed to issue stages regardless of the circumstances. The previous lino who used to do my stage interviews didnt want to issue them ,but as good as admitted that he was being told to do so.

absolutely correct, 'all managers ARE told to issue them' and as you say 'regardless'. as i,ve said in a previous post, an ex gaffer(now retired) and a mate of mine and a good few other staff told me years ago, that HE was told by HIS gaffer that all stages were to be issued, this is before the interviews had even taken place. so much for each case on its own individual merits. bollox.
