I'm a bit late on this and don't really know what I'm looking for but thought I would post it. In December I got terrible knee pains and was initially signed onto light duties by my doctor. My Line Manager said their were no light duties so I had no choice but to go on the sick. After a month they contacted me agreeing to light duties, I came back and at the end of my first day my LM again said there was no light duties and I would have to resume normal work so I had to go off for another month before I finally got a letter signed by my LM saying he would accommodate me with light duties as long as necessary so I started back, this was late Feb and I was on light duties until last week.
The thing is after I came back I got my second stage warning. My LM didn't do it, he waited until the end of my first week back, when he was off and the stand-in manager did it. I argued my case saying I tried to come back but was left with no choice but to go back on the sick. He said he found no "mitigating circumstances" and issued it, but it was obvious he was told to give me the warning no matter what was said.

Re: 2nd Stage Warning
they are abusing the stage system because the 1st and second stages you cant appeal against.
looks like they are trying to lower the evr bill by hoping a tribunal will pay less.
best thing for osties who have knee problems is do not go back until you are happy you can do a walk.
did they get you to go to a physio?

also bear in mind opperational needs means the business will change the need for "light duties".
speak to a union rep and if you get no luck see your doctor re being disciplined whilst under a cert.
they take a very dim view on such things.

Yeah they eventually sent me for physio. If I speak to my doctor what can he do?
This is how petty and stupid they are also - they have had me working in the afternoon in the Caller's Office - I like this duty and it is 30 hours which I am contracted too. Nobody wants to to do this duty, they have a 39 hour guy on it and have me back on delivery, complaining that I won't do over my 30 hours.

a doctor can sign you off for as long as you feel your knee will be good enough to walk.
last thing they really want is for you to keep coming back draining the nhs at the moment

Re: 2nd Stage Warning
I've had my first week back on delivery after the physio recommended I could walk 4 hours a day. I was listed on Wed to be training on a duty and when I arrived in my Line Manager said he needed the trainer elsewhere and I would have to do it. I went to the DOM and he said do what I can, if I could only do an hour he wouldn't argue with me. I was out probably 4:30 in all. I've been happy enough because I've been taking my time and working until my cut off, my knees have felt fine. Incidentally not one manager has asked how I've got on.

Re: 2nd Stage Warning
same here
i went back and i wasnt asked how i was either.
the physio has now said i can go back on delivery (still suspended for cutting off though) for 3 hours although my knee doesnt feel 100% yet.
had set backs with my excercises
also the physio said i could have a degenerate knee.that wasnt mentioned in the atos report.
looks like they are milking your absence to try punish any further absences.
also why is it in our office if you phone up and cut off you get suspended?
i take it you cut off by not taking all the work out??

Re: 2nd Stage Warning
The first day was P&L and we left a loop and got finished bang on time. Since then I've really only been used to cover off the bits and pieces other people have been leaving so I spend a lot of time hanging around while the managers take an eternity to decide what to give me to deliver. I've had some BS from the managers looking me to take more than I do but I stick to my guns. Been an easy week. This is my first real experience of P&L. I used to be rusher to try and get finished early but I know no those days are dead so I just take my time. To be honest I'm loving it.flaminmoses wrote:same here
