out of contract

I've been employed since 28 march my contact was 3 months so I have been out of contract for over 6 weeks I have seen my dom about this and all he said was I am employed on a day to day basis I am not the only one at my office I've asked the union the rep he was stumped can they do this as I am basically waiting to be laid off

No no--get this fixed out, if your original contract was for three months, you should have either ben laid of then, or had another contract with your new terms and conditions listed----they are taking the mick big time.

It's 4 years!
The law states 4 years,we have a 2 year agreement..................which RM are ignoring.

still in the same boat last piece of advice was if I am still getting paid I am still in a job . union rep does not have clue ie does not care I have not got in contact with area rep yet so that's my next step I am on my own with this as the other boy's that are in the same position as me don't wont to rock the boat

You still have a contract...the contract you started on,it just doesn't have a termination date anymore because that has been allowed to lapse.
Royal Mail are now legally obliged to give you reasonable termination notice.
What's reasonable is pretty vague but anything under 1 month i would personally consider unreasonable.

If they have 'renewed' your contract, they nust send you written details of terms and conditions--again, write to your DOM and remind him of his LEGAL obligations!

If you mean Statutory protection against Unfair Dismissal...yes...but you are protected against certain types of unfair treatment for day 1 with a combination of our Collective Bargaining Agreements and The Fixed-term Employees (Prevention of Less Favourable Treatment) Regulations 2002 which means that employees on fixed-term contracts are treated no less favourably than comparable permanent employees.
If you are talking about redundancy terms it's two years before you have the same rights as a permanent employee.
If you are talking about being automatically made permanent it's 4 years.
