pre booked holidays whilst off sick

Hello i need an offical answer on this if possible. I booked a holiday in the new year for september. I have just found out i have to have an operation in August. I should be fit to go as all i will be doing is relaxing. I will not at that stage be fit to return to work so will still be off sick. Whats the official ruling on this. Some long term sick people that work in my office have been told they have to have a face to face weekly with the DOM and holidays are forbidden. Does anybody know. thanks

hello Rio, I`m in a similar position and phoned HR, they told me that whilst off sick RM staff should remain at their home address, but if their line manager agrees that it would be beneficial to the rehabilitation and recovery of the member of staff then the line manager can allow it. But I would definitely advise having a rep in the meeting with you when you ask your DOM and it may be helpful if you could get a letter from a health professional to agree with the holiday being beneficial to your recovery, hope everything works out and your recovery is quick, and enjoy your holiday.

A guy at my place was off sick and it run into a holiday,his lino was aware and said cause he was sick(covered by a docs note) he would get his holiday credited to him depite him going on it as it was pre booked.
Depends on the managers i guess.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

Hi there,

my experience is you get your holidays back that you were due to take if you are off sick.

My other experience is fortnightly management review meetings, but these aren't set in stone and sometimes a month could pass without one.

So I wouldn't worry about it, take your holiday and see if there's any comeback. If there is put in a grievance for unfair treatment. You are recuperating, no matter where you are. Then you should get your leave entitlement back as you were signed off sick.

Nothing wrong with talking to your rep about it for advice, though.

Suggest you do a google search for the ECJ decision case of Stringer and also the ECJ decision case of Pereda there is also the employment tribunal case of Shah v First West Yorkshire Limited (2009).
