Revisions & 30% rule on duties changed

I understand from various posts in forums that where there is major change within a unit and more than 30% of duties are affected, then a total resign is necessary. I have just read through the Way Forward Agreement and cannot find a reference to the 30% limit. I am trying to find out whether the 30% relates to attendance times or to duty content or both.

Can anyone help me locate the official source of this ruling?

5. Section 16.2 of the Way of Working Agreement defines "Major Change" as:

.the relocation or merger of units
.a significant process alteration arising from automated working or reshaping of the pipeline
.delivery revisions, which involve significant re-plotting of walks or significant restructuring of attendance
patterns (e.g. full time/part time mix, five-day weeks, "longs and shorts" or nights plus a first delivery, where
they are agreed).

For a re-selection exercise to be considered the extent of such a change must be that it has a significant
impact (in content and/or attendance times) on over 1/3 of the jobs in the unit. (New jobs should be included
in this number).

I was under the impression that even in the case of a total re-sign, if a particular duty had not been affected, the duty holder has the right to retain that duty. Is that still the case?

Yes...but in a total resign/major revision it's unlikely that many duties will see no change to either duty content.attendance times or delivery methods.
The question and grey area will be what represents "significant change". :neutral:

Understand 16.2 of the Way Forward - still not sure where the 1/3 comes from ?

I think my duty will be unchanged but the 1/3 rule could well be breached so not sure if I can stay on it. Lots of staff interested in this rule and how it is going to be used.

As we move to a 39 hour basic week it begs the question Won't all duties have 100% change ? or is a reduction in hours across the board exemt?

Agree with you about the interpretation of 'significant change'

6. While it is not possible to be totally prescriptive as to what constitutes "significant", cases will need to be
judged on their merits, using the attached "Guidelines" (Annex 1). The test should be that it could be argued
that, to all intents and purposes, the job is no longer the one previously signed for.
7. The logical approach is to first confirm the number of unchanged jobs, using the Guidelines. For there to be
a full office re-sign the number of unchanged jobs must be less than two-thirds of the total (including
reserves). In these circumstances, the facility of a re-sign will be agreed with the changed and new duties
being jointly identified with the appropriate CWU representative, as specified in the "Procedure" section of
Annex 1. (The decision tree at Annex 2 illustrates where an Office/Unit re-sign is appropriate).
8. There will be a further review of these arrangements in the light of working experience, to ensure that the
objectives set out in paragraph 4. (above) are being met.

Although I downloaded a copy of the Way Forward via a link in the forum it made no reference to the 1/3 rule. I assume the Way of Working agreement supersedes it.

Perhaps that was why ALL the duties in my office were chopped up and then cobbled back together again. :hmmmm We thought they could have just stuck some extra bits onto the ends of the exixting duties but then they might have fallen foul of the 1/3rd rule.
As it is now everyone's duty has been changed by much more than the 1/3rd but, even if they only "Grew" by less! :shock:
