Broken Ankle trying to IHR

Hi need some help or info on this subject.

A girl fell just before xmas and broke her ankle in 2 places and a bit of bone is still floating about in side her ankle.(she was not given any snowchains even though she had asked for them)
Her consultant is reluctant to give her a time guide-line for a possible return back to work until at least the middle of July when he sees her again.

Atos however last month after a medical informed the manager that it could possibly take another 6 months to heal.
Manager already passed this info on up the line and they want to IHR her.
She is only p-time 24hrs a week and does not want this option as she is in her 20's and feels optimistic that she will return in a month or two which will still only be a possible 8-9 months after the accident.

Can they do this?

Is there anything she can do to stop this?

Do they not have to wait until a year has passed 6 months full pay and then 6 half pay.

register the aod with Department of work of pensions, contact legal services and put in a claim against Royal Mail and contact branch secretary asap.

I've been off since last september.
Initially i had a few consultations over the phone and my 1st face to face with an atos doctor in march.
At my last face to face which was 3 weeks ago, the atos doctor told me that the ihr criterior kicks in after 9 months from the 1st face to face meeting with an atos doctor and not the 1st day of absence.

i broke mine 2 years ago getting out the van and down a pot hole still had no compo from royal mail and now i have to go and have a big opp next week to try and put things right but ATOS have not got a clue so watch what they say i am still on restricted duties and will more or likely have to stay on them after opp a broken ankle for a postie is not good as every day it gets battered and never gets a chance to heal

Wrong - A ATOS doctor only has to give the opinion that the likely recover will be long than 9 months ..Its not you can be off for 9 months before IHR is considered....Read the rules again my friend.

She can also refuse to accept this decision and appeal it all the way. Which may time delay the IHR. Perhaps she should speak to her union rep too.

AOD was it,why would they want to IHR that quick,also no proper safety stuff she could sue couldn't she.
Also if she's been with RM for over a year she's entitled to 12 months full pay...

Also please note RM AOD's went up by 500% in Dec last year because of the snow!

Hi Postman,

I am not sure if that document still holds,
in the IHR document it tells you that it now superceeds any previous agreements

AOD and it's recognised by the DWP as an Industrial Accident then it's 12 months full pay.

Is there anything in writing to confirm what you are saying?

My manager has told me that the IHR document is the most recent and it was agreed with the union so that is what they are using to try the IHR.
I thought the same as you but was told I am wrong.

I think we've got crossed wires here lol,i'm talking (and uploaded the relevant doc/scan) about 12 months sick pay after an AOD.

With regards to IHR docs,can anyone on the site point us to anything.

The most up to date IHR agreement is the - Agreement Between Royal Mail Group And Unite-CMA And CWU On Managing Employees With Long Term Ill Health 2009...and it doesn't mention sick pay after an AOD.

I must of used RM's thinking when I interputed troubles post.

Yes sick pay after an AOD is paid for 12 months on full pay

IHR now RM try to pay you off with any illness that is likely to last longer than 9 months from the medical opinion given by ATOS

I am just glad that you and others on this site are so up to speed with everything, as a lot of great advice and help is given CHEERS
