just query-ing what is my rights on paternity leave . my wife has given birth a month early . but im being refused the time of . not sure where i stand..at moment still working

I would go in tomorrow and ask on what grounds it was refused

did you keep your office updated on the expected DOB and had you applied for paternity leave beforehand based on the due date?

If so I cannot see any reason for it to be refused I would go and have a word with your DOM

after all it is not your fault the baby arrived early and as long as you have met the criteria you are entitled to paternity leave ( paid or unpaid depending on your service - even if you don't qualify for paid you should still get the time off)

as I said go in for a chat tomorrow and ask for any decision to be given to you in writing ( take a rep in as well) this should be a happy time for you, you should not have to worry about getting time off to spend with your new family

thanx for the reply . kept office up to date as wife had bad pregnancy . she gave birth monday . i went to manager on my day off tuesday to request my leave now and was told no i need a meeting with him . i gave matt b one form in when i new my wife was pregnant . got meeting tomorrow now as he got called away today .

This should give you any info you need regarding your rights and entitlements for paternity leave.

The bit you might be interested in is:-

"Not giving the correct notice
If you can't give the full notice period to your employer for a valid reason you should still give as much notice as possible. A valid reason might be, for example, if the baby arrives early or the adoption agency doesn't give you long enough notice.

You may still qualify if you meet the other conditions or would have if your baby had not been born early. If there is no valid reason (eg you simply forgot) you will lose your entitlement."

thanx checked NOT GIVING THE CORRECT NOTICE . they new the situation for the last few months about my wifes problems with her pregnancy . will c what they say tomorrow at the meeting .thanx again

Our baby came late and our manager let me put my leave back, obviously it suited him as they were short staffed, however your dim should accomodate you and let you have the leave at even if you had to wait 24 hours to start it due to coverage etc.. typical royal mail suiting themselves... but they are family friendly aren't they???

unfortunately its not unbelievable in this day and age.its normal practice to refuse any request until you fight them for it.

thanx for the comments and support. i am on paternity leave from monday for 2 weeks as they have cover.
the meeting i had lasted 2 minutes asked when want it and told monday as now would be beginning of week agreed straight away signed form and all done . still thought i would of been entitled to the leave the day my wife gave birth but im gona enjoy spending the 2 weeks with my family . as i say thanx again for the support and help.
