Can this be classed as B&H

Post by music4essex »

As some of you on here have seen by some of my posts regarding the dog bite incident, I am up for conduct code on not completing my duty and cutting off, which in turn with my manager seems to want me out.

I will try and put in some kind or order to what happened, on my first week back after dog bite, whilst out on delivery had an argument with the owner about the position of the stand alone post box, he threatened me and also was quite abusive and swearing,( I don't swear much and certainly not while on duty)
Told both dom dim next morning.

On the friday of that week, the dom asks me to write a report, before going out on delivery :arrrghhh
I usually get out at around 9am but after doing the report and collecting specials left at 9.45, both dom& dim saw me walk out at that time.
my times are 6am till 2.10, we have 40 mins meal releif and 15 mins to cycle back to office so basically we finish delivery at 1.15pm, I cut off at 1.25 and got back to office at 1.40 with cut off.

On the sat morning dom called me in and asked why i cut off told the reason why , he said someone went in to say i was going slow which was incorrect ,as I had someone ill at home so no way was I going to go slow(not told dom this yet)
I was so upset with the accusations I went sick with doctors certificate for anxiety.

I also had been in touch with security as I thought RM were to slow too sort the dog situation out, which in turn said I should come off my walk, when dom said this to me I said no as nealy all other folks on my round are really good

got a letter to say if i did not return to work they would assume I did not want to resume work with RM,
I felt quite bullied so returnded.

I had a meeting with dom with area rep in with me asking questions, week before last I had a meeting with dom as a fact finding report with area union rep,
basically dom asking what time I finished each road, which i said roughly what time depending on how much packets and signed for i had,

its been a week and not heard anything also while out on duty the dog has been out in the garden no gate across driveway
so not delivered twice to the property, On saturday I asked the dom to get the mail picked up by the owners, he refused and told me I had to do it, I got really stressed out and was in tears really upset don't want to admit it but really sobbing, which is not like me I will put up a fight, but I am really worried about losing my job, (22yrs next week I have done)
the dim took me in the office and basically told me to come off my round, and they would put me on another, but that would only make me worse and they know the reason I stay on mine is that i can be near to my son if he is ill(13yrs)
I feel they are bullying me to go on another duty and they told me I have to seriously think about it over the weekend,
I have been o this round for 5yrs + and I am no 7 in seniority, I am really stressed, but tomorrow I have atos ringing me to do with dog bite, but I am really worried I am going to lose my job, can they tell me I have lost my job even though i have never had a warning or have anything on my record?

Your comments are welcome, as I am not looking forward to going in tomorrow also a bit  emmbarresed about crying

There is a conduct code to follow,(and a mail integrity agreement too). None have been followed.

i'm not really clued up on these matters,,,, but if you feel you are being bullied and harrassed,i got told you have to produce evidence,, solid evidence of this happening,, these days it has to be voice recorded or video recorded to have substance.. then go through the grievence procedure.................... before it can go to any kind of court.. what you are experienceing is happening through-out Royal mail. its sad this is happening to you and many others,,,

First of all the Manager cannot make you deliver Mail unless you think it is safe to do so. If the Dog is in the Garden and has previously bitten you then they should have delivered a letter themselves explaining to the customer further problems will result in suspension of delivery. I think there is a standard letter . Ask the DOM if this has been done. As with Cutting off , as I say to all members that E.T. generally come down on the side of R.M. if you do not inform the Manager before you go out that you are cutting off as this is a reasonable request from R.M....did you do that .....If you are slow why coming off a delivery round be the answer ? DOM is being naughty here ! :no no

sounds like bullying to me but these B and H cases drag on. Mine took 6 months ( although guidelines say it shouldnt) I did get a written appology from my DOM as it was aimed at him - but I'm not sure it was worth 6 months of worry at the time. I have a good union Rep - always there for me if i REALLY need help. Thats what you need - someone who's always on your side. Good luck!!

now just want to put it in the perspective your dom will probably be looking at things from what you've told us on here

1 Mail security issue you have stated that you left your mail bag on your bike whilst walking up and down peoples drives and you told your dom you did this

2 Because you left your bag on your bike you have also partly contributed to your own accident on duty as you could not follow correct dog procedure as you had no bag to attempt to position yourself between you and dog

3 you could be accused of cutting of early, you stated that you returned to your office at 13:40 but finish time was 14:10 (yes you said you take break at end but they could say you went home early)

4 you say you have anxiety about delivering to the afftected houses and you were offered a reasonable adjustment and you refused and then went sick again due to not taking the reasonable adjustment

so yeah think they might be gunning for you but you got to watch how they are going to spin things if they do!

Where's the reasonable adjustment? Moving the delivery person doesn't resolve the problem of the dog, all it does is cause the same problem for the next postman/woman.

Its a reasonable adjustment as it takes her out of a situation she finds stressful, she refused this then went sick with anxiety for the exact reason they offered to move her, if she had went along with their adjustment she would not have went sick with anxiety of delivering to those houses, that's the way the dom will try to paint it

When you got out at 9.45am instead of 9.00am you really ought to have realised you would not be able to complete and advised a manager accordingly, in the eyes of the RM management you have cut off without advising them you would do so.................that was your first error!

Then you went sick cos you felt bullied, nothing wrong with that in my opinion, but you should have put in a grievance to back this up, I'm guessing you didn't...............that was your second error!

You need your rep to step in and sort this mess out, are you in the union?

Good Luck, and should the situation ever arise again then you must inform your manager you may not complete, what happens after that is up to them.........and not your problem (always take a colleague in as a witness)

As I said..........Good Luck :)

It was most likley the dog owner, who reported you, out of spite (particularly if it was a false allegation).

As for the question of if what's happening to you is B&H: Well, the letter stating that if you didn't return to work, they'd assume that you didn't want to work for RM anymore, is BLATENT intimidation! So yes, it IS B&H. The rest, I'm not 100% sure of. But my gut instinct, is that it's sustained B&H, and needs dealing with ASAP.

When anyone is in doubt about completing their delivery they should notify their manager and ask them what you should take out, that way they are responsible and NOT you, have a witness listen in to what the manager says and states would help, play them at their own game eh, it's called passing the buck, works a treat for one postie in our office
