Does my Manager HAVE to make the effort for atos report
I have received today an atos report which I am happy with at last. Briefly it says:-
Osteoarthritis considered a disability.
Should not be asked to walk for more than 3 and a half hours.
Allocated a round with as few stairs and inclines as possible
If the business can support it, should be allocated a permanent round to ensure continuity. So, I'm looking forward to all these things!!
Does my manager HAVE to find me a delivery with few steps and inclines on? He already says he can't, but I know he could if he put in a little effort!!

keep a copy of the report with you at all times.
refuse to do more than the ATOS report states.
your DOM will be a bit arsey but in my experience the CWU will back you all the way if you have the report to hand.
best of luck with it.

Yes.
The 2010 Ill Health agreement states that "where the advice following referral is to offer adjusted duties or suitable alternative work, careful consideration needs to be given to the type of work suggested".
These discussions should "ensure the alternative work meets the employee's capability, aptitude and fully complies with the medical advice received.
Possible roles should be identified, even if there are currently no open positions. If necessary the OHS should be consulted on the suitability of such roles prior to investigating placement opportunities.
All practical and reasonable measures ought to be exhausted by Line Management to secure a placement opportunity within their own sphere of influence in the first instance, especially where the type of work identified already exists under their control."

Then put the proposal to him in writing - or get your rep to.toastie wrote: He already says he can't, but I know he could if he put in a little effort!!
If he isn't willing to make any effort to accommodate your disability, then that is discrimination.

Wrong - Only an E.T. will ultimately decide any if it classed as a disability and discrimination. R.M. only have to find reasonable adjustments to your round. However an E.T. usually find that a company as large as R.M. should be able to make this adjustment unless R.M. make a good case that it costly and they could not sustain your abilities ...I would say be very careful what you wish for...How can a G.P. or even ATOS that your condition means that you cannot walk over exactly 3.30 hours...What would 15 mins or even 30mins difference make .....You have to view these things as how and outsider would view them..Some medical person would have to re-write that they would only advise that they recommend that you do not walk over 3.30 daily...clashcityrocker wrote:Then put the proposal to him in writing - or get your rep to.toastie wrote: He already says he can't, but I know he could if he put in a little effort!!

I am only contracted to work four hours a day so the 3 and a half hours thing shouldnt be an issue - its more the steps and inclines and having to look at giving me a regular delivery which he is not happy about.

You can access all Royal Mail Group policies on the company intranet but it is only available on work computers. Anyone with a Local Area Network password can get on to the intranet by validating their account using their National Insurance and payroll numbers. Click on Start and you will get the intranet option.toastie wrote:Thank you everyone, and 'MinisterofCucumber' I'm going in armed with your extract tomorrow. Phone HR, their phone number is on your payslip, and ask for a LAN account.
This website, Royal Mail Chat, also has a lot of policies in the 'Downloads' thread.

That is what makes me sick, reports on here are peeps are thrown to ATOS to get them back to work asap but if the report doesn't suit the managers it's dismissed.Gazza90000 wrote:Wrong - Only an E.T. will ultimately decide any if it classed as a disability and discrimination. They can't have it both ways.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

Hi,
I agree about being wary of how useful an ATOS report is. I've seen one that will be put to the test at an ET soon. In the report it says "...employee is fit for duty IF..." and goes on to say what the conditions to be met are. Then they ignored the conditions and demanded she returns to work the following week.
The comedians in the DOM's office just used the quote without the word IF etc. and stopped her pay.
good luck
