just wondering if anyone can shed any light on this charge i have had made against myself.i drove a royal mail vechile back to the office with a puncture and as a result have been charged with gross mis conduct under health and safety.the vechile needed a new tyre and wheel but i was on collections and geuninely did not have time to change the tyre!!!!!!!!!!,i have been told i could be dismissed after 21 years service,any help appreciated,thankyou.

No time to change the tyre? You drove it back to the office?! How far exactly? Were there sparks flying from the rims?

The wheel being damaged is a huge concern as is the distance travelled, none of which you have really mentioned.

Seriously, what do you expect? Collections are timed but not to the extent you potentially flouted nearly every road law on the book.

Advice? Contact your area rep ASAP

We are told the same.

They will also mention you signed the vehicle off as safe when it left the yard.

The Road Vehicles (Construction and Use) Regulations 1986 Regulation 27 section b states "the tyre is not so inflated as to make it fit for the use to which the motor vehicle or trailer is put".

In essence that means if the tyre is flat its against the law to drive on it whatever the circumstances - as a driver I thought you would have been aware of that.

As Pat stated best to get your Area Rep involved but be prepared for the worst.

i work in an office where if you miss the dispatch you are liable to feel the force of the conduct code,hence why i didn,t have time to change the tyre and just my luck no credit on my mobile!!!!!!!!.sometimes we make decisions that are incorrect and i realise i made the wrong one but is it really sackable.

i drove approx 1 1/2 miles with a half flat tyre albeit slowly!!!!!!!,no sparks coming from the rims and i reported it as soon as i arrived back at office and filled report out!!!!!!!!!

Yes it could be sackable but that doesn't mean you will be.

Have you been suspended then I take it?

First thing is to go sick with stress.............................

Next thing is to say you didn't notice the tyre until you got back to the office, if you have already said you did then change your story, with a witness.

If it happens again ring the office and speak to whoever is most senior and explain what's happened and ask what to do, I would have found somewhere safe to change the tyre and any scans that were missed ad hoc them and put in the closest reason to flat tyre, I'm sure there is one.

As long as you haven't admitted to knowing about the flat and then driving back with a witness present you should get away with it, but next time use your head and say it just happened as you were turning into the yard!

If you miss the despatch, can you not take the coll to your nearest MC then claim OT for the OMV breakdown.

This would have allowed you to change the wheel, complete the coll, and the mail gets processed.

i have said i noticed the tyre was hissing and drove back slowly to the office ,but the tyre was shredded by the time i got back.
