When you say unchallanged...

Have you a rep there? Has your branch been contacted?

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

With ref to stage1 and 2 it is well known that the attendance procedure/how managers use it is not fit for purpose. National level talks are taking place on a new procedure. HQ need any and all unfair warnings flagged up to strengthen the case for change.

The £3 a week is being paid for representation not guaranteed results.

Sackings, Suspensions and warnings; Are OPGs appealing and are they requesting a CWU rep to be with them? What are they for is the OPG guilty or not guilty? Has the manager over reacted? Has a area rep been in contact with the manger issuing the suspension. If appeals not succesful has a requset for tribunal representation/assistance from CWU HQ been made? If so are HQ giving assistance or turning the case down?

Perhaps you could take on the role of rep and provide the the sort of representation that you feel is not happening, the Union Skills 1, 2 and 3 courses and the postal agreements/procedures course combined with your passion for quality representation would turn you into very fine union rep indeed!!!

I think by not challenged Daz members are quite rightly concerned about the overall culture of bullying in Royal Mail rather than individual case representation.
Remember this...........
5. The interim agreement also includes commencement of a new project, which is committed to bring about positive workplace cultures in every office and improve long-term industrial relations to bring stability.
Again, this project will be supported by independent experts and will allow us to address the bullying culture that exists within the company.
Heard any more about it....?
All i hear is sweep, sweep, sweepety sweep. :cuppa

What are bullying and harassment?
These terms are used interchangeably by most people, and many definitions include bullying as a form of harassment.

Harassment, is unwanted conduct related to a relevant protected characteristic, which has the purpose or effect of violating an individual’s dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment for that
individual.

Bullying may be characterised as offensive, intimidating, malicious or insulting behaviour, an abuse or misuse of power through means that undermine, humiliate, denigrate or injure the recipient. Bullying or harassment may be by an individual against an individual (perhaps by someone in a position of authority such as a manager or supervisor) or involve groups of people. It may be obvious or it may be insidious. Whatever form it takes, it is unwarranted and unwelcome to
the individual.

The legal position
Employers are responsible for preventing bullying and harassing behaviour. It is in their interests to make it clear to everyone that such behaviour will not be tolerated — the costs to the business may include poor employee relations, low morale, inefficiency and potentially the loss of staff. An organisational statement to all staff about the standards of
behaviour expected can make it easier for all individuals to be fully aware of their responsibilities to others.

Summary of the Law
Harassment
Harassment is “unwanted conduct related to a relevant protected characteristic, which has the purpose or effect of violating an individual’s dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment for that individual”. The Equality Act uses a single definition of harassment to cover protected characteristics. Employees will now be able to complain of behaviour that they find offensive even if it is not directed at them.

In addition, the complainant need not possess the relevant characteristic themselves and can be because of perception or association. Harassment applies to all protected characteristics except for pregnancy, maternity where any unfavourable treatment may be considered discrimination and marriage and civil partnership.

Bullying
It is not possible to make a direct complaint to an Employment Tribunal about bullying as it is not related to a protected characteristic.

Your right not to be harassed by third parties
The Equality Act makes your employer potentially liable for harassment of their employees by people (third parties) who are not employees of your company, such as customers or clients. They (your employer) will only be liable when harassment has occurred on at least two previous occasions, they are aware that it has taken place, and have not taken reasonable steps
to prevent it from happening again.

Legal information is provided for guidance only and should not be regarded as an authoritative statement of the law, which can only be made by reference to the particular circumstances which apply. It may, therefore, be wise to seek legal advice.

Would argue this one. you can go to tribumal citing lack of faith and trust in you managenent, and bullying could be a cause of this.
