Ive recently passed my driver risk assessment and starting a driving duty on monday. the duty i have asked for and being put on is a 30hour a week duty. i have been employed for about 5 months so still under my 6 month probationary period as a 25 hour a week contract. i asked my DOM today about my anual leave pay as i have a few weeks off next month and he said because i will still be on a 25 hour contract but with 5 hours overtime everyweek i will only get paid for 5 hours a day as its in my contract. instead of what i would be working, which would be 6. Also he said that because i might not be there in the next 3 moths he wont pay me anymore than my contracted hours. but i feel i am more than likely going to have this job for a good while, unless i f**k up bad.
I feel that i am fully entitled to 6 hours a day pay from anual leave as i will have to sign another declaration of work for this duty, and he has no-one else that wants the duty apart from me unless it goes fulltime. its backshift.
The only thing i am worried about however if i fight this "battle" is that he will just take me off the backshift and put me back on a regular 25 hour a week delivery duty. which is more inconvenient to me as backshift means an extra 5 hours a week for me, potentially a van to take home, and more time with my other half. she is also backshift.
i dont know what to do, ive not spoke to my rep yet but ill will when i see him.
should i just bite the bullet until i am permanent with more hours contracted? or fight my case?

If you work 6 hours a day for 5 days a week he HAS to pay you for 30hrs. On the other hand ALL holiday pay WILL be based on your 25hrs as per your contract!

Personally I would wait until you've done your 6 month trial period before sticking up for yourself because you never know they might offer you a 30 hour contract after your trial period, where as if you stick up for yourself (something royal mail dont like) they might think screw him and give someone else a 30 hour contract AND your duty and you get stuck on a rubbish duty. So bide your time until you get a more perminant contract (how long will your new contract be for? 3 months?) but dont let them walk over you, if you're working 30 hours then you make sure you're paid 30 hours.

i will have been their 6 months at the end of my 3 week anual leave next month. he said at my interview it would be 6 months, 6 months (with revisions every 3 i think) then permanent.
thats what i was thinking. i dont want to f**k up my chances of keeping this duty. but it would be £120 i would be losing in those 3 weeks.

if a temporary member of staff who is looking for a perm contract should do this really is up to you but i could certainly see whats likely to happen unfortunately

- that's unusual, usually you're on a driving duty for months or even a couple of years before they think about a driver risk assessment .
