Not sure if this is the right forum but couldn't find a more appropriate one.
Basically my contract is 20 hours per week 3 month rolling. I asked my line manager yesterday about my Bank Holiday entitlement over Easter, to which he replied I'm not entitled to Bank Holiday pay for this week due to working too many hours, including tomorrow I will have worked 32.5 hours this week. I then questioned him about next week, his answer 'you won't have worked enough hours next week to qualify for Bank Holiday pay. I'll be working 15 hours next week I believe. I pointed out to him that this didn't really make sense, but he left it at that and said he'd check up on it. From past experience this makes me think he won't be checking up on it and I won't be automatically getting paid for Bank Holiday unless I start hassling him about it. So would just like to know what I'm exactly entitled to. I cannot find a copy of my contract to see if it specifies there.

If your scheduled "day off" is not on a bank holiday, I believe your manager is extracting the urine, but hopefully "Fish Tank" or another guru will confirm this...
On a 20 hour contract, you would normally be paid to do 4 hours per day over 5 days (whereas I get paid to do 4.5 hours a day over 5 days on a 22.5 hour contract, often working over 35 hours with overtime). So on a bank holiday, if it is not your day off, you are entitled to 4 hours pay, in addition to the actual hours you perform. How many hours you have worked has absolutely nothing to do with this, as far as I'm aware, so if your manager is spouting this rubbish you should be putting in a grievance. Have you joined the CWU and appraoched your depot's union rep about this issue?
Today happens to be my floating day off, so I will get an annual leave lieu day credited to my holiday allowance for the year, just as I will on the May Day Bank Holiday in ten days time.
Do not think that taking everything your lino says as gospel will guarantee an extention on your contract, know your rights and defend them. It sounds like your lino is counting on you and others in a similar situation at your depot being clueless about your rights and not fighting back, giving him/her a bigger bonus, as less "man hours" will need to be paid.

I do 5 hours over four days excluding over time. My scheduled days off seem to be whenever it suits my manager but are supposed to be Tuesday & Weds. Today is the only day I've had off this week. So to get this straight you think because Friday is my day off I don't get paid but get a day in lieu? But I should get paid for Monday as it's one of my working days? I'm not part of the Union.

If you agreed to take today as a scheduled day off, you will not get five hours pay for today shown on next week's payslip. You should get an extra annual leave day added to your contract allowance, so I'm presuming you should now have 6.625 holiday days (given that basic holiday allowance is 22.5 days per year and you are contracted for a quarter of one financial year, plus part days cannot be taken so you should be given 0.625 as part of your final payslip of this contract, unless of course you get an extension).yhtorb wrote:I do 5 hours over four days excluding over time. On Monday, I believe you should get 5 hours pay, if you have not agreed to take it as a scheduled day off.
But again, I stress, you should await further confirmation of this from other forum members.
If Tuesday and Wednesday are your scheduled days off, they can only be changed by your lino with 28 days written notice, that is if proposed rota changes do not suit you. From an overtime perspective, given the workload is heavier for the latter half of the week (with possibly the exception of Saturday), it would probably be in your interest to work Weds-Sat.

I actually mis typed. My days off are Tues and Friday. The 28 days notice is interesting to me as my lino told me yesterday he was swapping my day off next week from Tues to Weds as he had no use for me on Tuesday. He's been known to pull this sort of thing with me before and a direct quote would be 'your days off are when i tell you'.

Any advice given on this forum is just that ...advice. YOU have then got to argue any case for with the DOM, dont feel up to it, get you're rep to do if for you. So simple
