Dog attack

Post by zaskar555 »

hello
I need some advise on a dog attack which happend in dec 10th 2010.
without going into to much detial i was taken to hopsital by my manager and photos plus accident report was filed at work.

Now late dec i followed this up with a claim with solicitors and they have asked for some info from royal mail by letters X2.
Now roymail have yet to reply to these and have not since. I also asked them months ago for the accident report and the signature from the special del i had for that address on the day. This is because the owner says his dog didnt bite me. That being said my manager was the one who took me the hospital , took photos of my leg and filed a report.

Now its come to the point 5 months on an the dog owner is getting away with calling me a liar so to speak. My solicitor phoned me Again asking me to chase royal mail up for this info as it would back my claim for the dog attach. I feel so bitter towards royal mail at the moment for making this situation worse than it needs to be.
I had one day off and 5 weeks on light duties as the bite went into my left calf and through my water proofs plus trouser, so you can see it got me pretty good, I limped for about 8 weeks and sometime suffer from slow aching pains when its been a hard day at work. I only ask royal mail to give myself what i need to help me fight this owner of the dog and im getting nothing back. Im not in the union and feel it might be to late to join to get some help here.

I would like to know what you chaps should think about my next move, im due in work to ask yet again what going on an feel like not being listened to.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

Welcome to the blue shirts, sorry to hear of your injury

I cant see why RM wont release the information. :hmmmm

I am not really up on civil law myself but what if you threatened to file a personal injury claim against RM. For example how long since the walklog was updated with hazards or dog warning cards etc. This might make RM consider releasing the information.

The CWU Area Health & Safety Rep should have been sent a copy of your ERICA report. You should contact him or her and establish if they do indeed have a copy and if so make a request for them to provide you with a copy.

I got attacked twice by the same German Shepherd and went to the Police the 2nd time and took the owner to court. I didn't even want the dog put down, just for this guy not to be allowed to own a dog.
All the court did was to say he had to muzzle the dog when he was outdoors with him, which was crazy as the dog had got out of the house twice where he didn't have to have a muzzle on.

As it happens, the guy has moved off my round. I think the dog wanted new meat as it were, but now I have another dog problem on a different part of my round.
It is again a German Shepherd and it is come out of the house 3 times in the past 4 months. Twice when the floater was on and once with me.
On each occation the dog ran up and looked like he wanted to kill you, but then ran back in. This has been reported 3 times.

Now I understand it's more of a mental stress attack that you are having rather than a physical one, unless you count pooing your pants.

The thing is I consider it unsafe to deliver to his house or the neighbours due to the proximity of neighbour's house to his.
Has anybody had a reasonable conclusion to that type of situation or have you had to carry on waiting for the next incident.

I think if u feel unsafe or threatened in any way shape or form, it's your managers obligation/duty to deal with it to a standard that you are happy you can do your job without fear of injury,
you need to voice your fears to your DOM and demand he deal with it, if you don't it will continue,
if u experience problems at an address on a regular basis, mail delivery can be suspended, but first they have to be warned, so do yourself a favour and keep on top of it, don't take any prisoners, even if it means not delivering the neighbours mail, most people like to keep on the good side of their neighbours, i know if i wasn't getting my mail because my neighbour couldn't control their mutt, i'd make their life a misery.

Next time you suspect any dog activity, DO NOT ATTEMPT TO DELIVER WHERE YOU CONSIDER IT TO BE UNSAFE - bring the mail back, and endorse each item with "dog loose" and the date on the front, and inform your manager at the earliest opportunity ( cos we all know your lineo's gonna be waiting for your return, don't we  ) and do this one every occaision, while also asking what he thinks is the best course of action in future - the answer you need to hear is "I'll write a letter to the customer telling him to control his dog & warning him if he don't, we'll suspend deliveries until further notice." What you would like to hear is "I'll drop it round there tomorrow while you're out on delivery tomorrow & try & speak to them about it." What you will probably hear is "I'll leave it on your frame for you to deliver tomorrow."
I don't suppose your mouth bleeds every 28 days, does it?

If it is a German Shepherd or Alsation or Rottweiller don't enter.

I have been bitten by an Alsation a few months ago.

 If you have reported it several times to your Manager and he has done nothing, shame on him, in cases like that, I bring back the mail, heavily endorsed, i.e. dangerous dog on lose' when eventually you can deliver it, dog owner may finally latch on! but report it to police too, one day these anomals do finally attack.

Thanks fellers,
My trouble is my manager has now gone on hols, i have upto the 7 may to get this copy of the accident report to my solicitors and already two letter have been sent to my office , at the moment the owner of the dog is making me out to be a liar and royal mail aint helping matters, (insult to injury ).
I just want things to be done right, on the matter of walk logs there has been no pink card placed on my walk for this dog , its mainly gone by word or mouth around the office about the dog, funny thing is 1 weeks ago i had another dog one the next close who is known on the walk log for being loose and threatening pinned me in the close as i would not walk past the front door.

Now this dog has a warning card placed on the fitting, This time i had to call my manager and he had to come out and pick me up in his car, but on arrival the owners had just come out the house and locked the dog in the back. This all took about 15 mins from the time i made the call to the manager and the time the owners locked the dog away, now the owners have been warned about this and letters sent. Myself and the other postie got told not to take mail to the house if the door was open. Thing is to see the door its kinda in a court year so to speak and it would be far to late if the dog is ontop of you. I really do feel this is not right and nor does the other postie whos round it is, This aint no small dog im worried about this time,
Im really getting fed up with royal mails outlook on this at the moment and it makes me feel im doing something wrong, its only a matter of time now before something really bad is going to happen. Anyhow i have had a email from my solicitors with the letter they sent attached to it for my manager which i will print and take in by hand.

I did also try refuse to take mail to the first attack but got told i should because they have a long drive and a post box at the end, my point is i dont feel like doing this guy any favours at present and dont want to have to bump into him and have words as this is how i feel. I know it wont help matters but when you angry for being made out to be a liar it kinda gets you worked up...maybe im being to nice about all this after all it was me that ended up in hospital with my pants down an tetanus( maybe it was all my fault)..lol

 For a manager to tell you to deliver mail, when you feel and are at danger is beyond belief Just refuse again, stating your concerns, and put it in writing! Report all attacks by dogs to the police---so many times in this job, we have been threatened by dogs, nothing has been done then they finally attack and injure either you or some innocent passer by!
What your Manger should at the very least do, is inform the owners that they must come and pick up their own mail---good luck to you.
