getting goods back after sacking

Hi need some advice after being under investigation and having ib come to take anything that thought was stolen then have no evidence that i had taken the items, at the interview stage i was told if i had receipts i could have them back i dont keep receipts and dont think i know anyone who does!! my case has been to court and these items was not meantioned so how do i go about getting back what is mine any help would be grateful rather than paying more solicitors fee's

That's an important question which will have an effect on his question.

As I understand it the IB and Police have to prove that items were stolen or formed part of a crime. Now they never produce all the evidence at the trial in case all charges are dismissed, they can then use the unused evidence if they decide to investigate further - they still have to get new evidence because of the double Jeopardy rules so they can't use the items as extra evidence but they can use them to get more evidence.

If he has been found guilty then even if he has proof he may not be able to get his property back because there is a relatively new law which means that people who have been found guilty of a crime may have to surrender items as restitution for their crime. Proceeds of Crime Act I think it's called.

So without proof of ownership even if found not guilty I think the chances of getting it back are pretty slim.
