On the 4/4/11 i went to my doctor with a painfully ankle . he sent me for blood tests that confirmed i had gout.
he then put me off sick i took the sick note into work i was then told by my delivery manager if it would be alright if he could refer me to atos i said ok.
atos contacted me on the following Monday to work out a care plan, the out come was that i would make a gradual return to work. i returned to work the following day expecting the care plan to be in place.
my manager said he would not implement the plan and only a full return to work could be except able this forced me to go back on the sick. this will force me to go on a stage 1. i have worked for the post office for over 28 years and have only been on a stage 1 once 8 years ago, i feel like the post office is not caring and is putting my health in jeopardy.

At at stage interview you should be asked if there is anything to say. Well I would:
1. Make sure that you take a witness in - ideally a rep or higher.
2. Make a statement, perhaps even type one up and print it on your computer, to the effect that you would have returned to work as recommended by ATOS but were unable to do so, and the reasons why.
That way it shows that you were willing to return to work. but more importantly it shows that you were making an effort to return to work as soon as possible. With this being one of the reason for having the sickness stages in place if it ever did go to stage 3 then you would have a stronger case for the stage 3 not to be issued, or for it to be rescinded on appeal if it went that far.
There is the nuclear choice of putting in a grievance against the manager, but that would depend on how aggrieved you are, and if you want to take it further.

I honestly think that you have to now start to just worry about yourself. I too have been in for a decent time ( 18 years )and used to enjoy my job, but RM really, really do not care about anybody. It's all about saving money and I am not convinced that the Union care either, although I want to be proved wrong.
You are no longer an individual person, you are simply just a number and they are not interested in your well being or your excellent sick record etc. They are only thinking in pounds and pence.
I would say to you, that you shouldn't worry about going on a stage. Stay off until you are completely fit and well, as you will still only be on a stage 1 regardless of how long you have off now.
Go back when you are ready and just look after yourself and treat management with the contempt that they treat you, without getting yourself into trouble.

I would talk to your doctor and see if in his opinion gout should be classified as a disability under the DDA (Equality Act).
Is the condition likely to last 12 months or more. Can they cure it?
Do you have any other underlying health conditions which have brought on the gout?

assuming it it a telephone interview with ATOS (always request a copy of the report) you do have some input into that report.
if the decision is to rehab you back in, ask the nurse to put in the report that a re-referal will be required should the workload be unacheivable.

Thank you for the replies very helpful. the out come of all this is i went back to my doctor who put me off sick for one week unless the manager aloud me to work for 4 hours a day .of cause he did not but referred me back to atos for a more favorable second opinion. atos phoned today and said i should return to work next week on full hours they completely ignored the first report. not surprised they are just puppets for management and i have been told are paid 80 pounds for their reports. my manager will be pleased.
