Help needed over joining the union whilst suspended

i need confirmation of a couple of points.

if i join the union after being suspended, is it true that the union wont represent me during the suspension hearings as the case started before i joined?

also, if the union wont represent me, and i dont want to use a work colleague, can i bring in my own outside representation into the interviews with management?

I agree with you some of these people are unreal, we had people at our office that scabed during the last dispute then tried to turn up at union meetings they were told straight away to f*** off, they will never be welcome back into our branch ever, headquarters may back them but locally they are finished

4.3 Representation In fact-finding and discipline hearings, individuals have the right to be accompanied by the relevant trade union representative for that location or by a colleague who must be from the same location who may assist in the presentation and/or representation of the case.

An employee may obtain advice from outside Royal Mail, or make a complaint to a statutory body, and once he/she has exercised his/her right of appeal and the appeal has been decided, the employee may ask an outside person to take up the case on his/her behalf. In addition, if the employee feels he/she have been unfairly treated in a disciplinary matter he/she may in certain cases have the right of complaint to an Industrial Tribunal. Details can be obtained from the local Job Centre or DSS Office. Such complaints must be made in a specific period of time. For that reason the code expects that all appeals against dismissal will be completed within three months of the decision to dismiss.

As far as the union is concerned you can understand why the union cannot represent you retrospectively.
We are a union with members who make the commitment week in week out...not a legal aid drop-in centre.
Would it be fair to spend the money those members give every week representing you?

In fact rule 3 section 2.4 states..... However, no member shall be entitled to retrospective benefits or services.

That is correct, the idea is to stop people doing exactly what you "appear" to be doing, and then after the dust settles leaving the Union. Some reps will act as witnesses for non members but that would be as a non union role no advice would or could be given.

On this one you are in a ctach 22 - the union cant/wont represent you and they are the only recognsied union for postman grades.

You can ask a colleague but they would attend as a witness on a voluntary basis only and I would think they would like release to attend if they voluntered, would you be able to arrange that or would your managers be likely to agree to it.

You can ask the manager concerned if he would accept a non Royal Mail employee attending as a witness however, Royal Mail can refuse and even if they don't they may have to through security checks as all Operational Offices within Royal Mail are considered a "secure area".

Although without Union assistance , you will be hard pushed to keep your job unless you are pretty smart , purely because you probably have no experience of procedures and rules and wont realise ifyou're being had over .I do have some sympathy however and think you might be entitled to some Union help outside of the interview .Im sure the reps who post on here might be able to clarify.I do realise a lot of people have left the Union of recent years but your circumstances give a very good reason why no postie should consider not being in the Union

its an interesting system, hypothetically you can be falsely accused, be sent home by management and unable to talk to staff on the floor, the union wont help you and you cant get outside representation.

Being falsely accused over things used to go on all the time where i used to work .I used to face a constant battle to keep my job at one point.Being in the Union helped protect me .When you get back to work ,join the Union and find out more about what it does and if you do and Industrial action happens , heed the call .It is what gives our Union strength when dealing with cases like yours (and mine).
