MAN HANDLED BY THE MANAGER

hi today i was manhandled by the manager, what i want to know is he allowed to do this or can i take it further. i believe this manager has it in for me and is doing everything to provoke me into a reaction. let me explain wat happened today as the missorts came in today and were sorted up i took mine round to my frame to put in with the rest of my work, but i had missorts in that work too, but the manager had already let people go out the office yet i had asked him before to wait till i had sorted my work up, so if i had any missorts they could be done. but as the missorts i had were for people who had already gone out i took them round to the town corner and lay them down on the bay. as i turned around the manager shouted at me to throw them off, and before i knew anything else he had grabbed my right arm forcefully turning me back around to face the town corner. i was shocked and didnt expect this, now after a few hrs my neck feels sore and im not sure if this is anything to do wat happened this morning. can anyone give me advice, as im sure this manager is out to get me thanks.

I'm not sure on this to be honest was there any witnesses as it would be your word against his, If anyone at all touches you without your consent I think it regarded as common assault which is a criminal offense.
If you wanted to take it further you could phone the police and actually get him charged with common assault plus go to your doctors and complain about your neck injury it all depends on how far you want to go with it.
I'm no expert on the matter so i would wait for more views but it would be of great help if there was a witness to what happened or it's just your word against his, next time if he does touch/grab you in anyways at all make sure you scream your bloody head off so everyone can hear you.
A lad at our office was once being harassed by a manager though he wasn't manhandled he made sure everyone and i mean everyone heard him shouting "stop harassing me!!!"

it would seem your manager may be losing it.

was anyone else about who may have seen this happen and if they was have a quiet
word with them and see if they would back you up if this was taken further.
but first write your own report while you remember everything and put down excatly what
your manager said to you. photo-copy your report.
also see your union rep tomorrow explain what happened to you and give a copy of your
report .
if your manager wants to see you about what happened take your rep in the office with you.
if you have no wittness about the incident be very careful.

thanks for the advice basially i did have a witness there who saw wat happened. wen it did happen i took the union rep in with me, who said that i could put in a report, but to make sure the guy who saw it would back me up, and he has agreed to do this. the other thing i was advised that if i do go all the way with this that the manager could make my life hell.

As long as you stick to your contract and follow proper procedures the manager can not do anything, if he does then it becomes a clear cut case of harassment and bullying which gain him a nice juicy suspension and possibly dismissal.

He launched a vicious and unprovoked attack.

That would be my story - and it's not a lie.

Your manager has no right to touch you in any context whatsoever if you do not wish it.

Obviously, as reasonable individuals, most of us would not take that to the nth degree.

However, if I was you, I'd milk it.

You feel frightened and intimidated at work.

You feel as if the manager is going to hurt you again if you do not comply.

You're stressed and over-worked.

None of this may be true, but it would be if it was me!

Surely what the manager committed was battery.

The difference between 'assault' and 'battery' is little more than a technicality. Here are the two legal definitions:

"An assault is committed when a person intentionally or recklessly causes another to apprehend the immediate infliction of unlawful force"

"A battery is committed when a person intentionally and recklessly applies unlawful force to another".

As you'll see, the wordings are fairly similar and they result in what is effectively the same charge (of either assault, or assault by battery, contrary to Section 39 of the Criminal Justice Act 1988).

quite right, the guys a bully let the police deal with him and don't be put off by the, it could get you in trouble brigade. evil thrives when good men do nothing, or something similar. what sort of firm do we work for when we think something like this is a topic for debate,call the police.

No manager should touch you in anyway,if he/she shouted at you and kept on in that manner then that is verble assult,if he/she touchs you physically then that is common assult,if i were you i would be talking to the bully and harassement line and i would also pop my head into the local police station to gain some advice,i would also be contacting the union and getting them involved of course you would not be able to bring yourself to go and work in that sort of enviroment and would be concerned for your fellow work mates and their safety being with a manager who is quite clearly not stable.

thanks again for all ure advice. im not sure wat i will do yet, as i have to think long and hard about wat i decide. all i do know if i had done that to him i wouldnt be a postman anymore.
