Wilful delay
Its come to my notice that Royal Mail have treated people differently when it comes to a charge of "wilful delay" Of course everyone should be treated the same. Does anybody know of a case where RM changed the penalty to excused delay instead of wilful?

Every case has to treated on the evidence and based on a reasonable investigation by the manager.
An employment tribunal would deemed a catch all policy on wilful delay as unreasonable.
The employment tribunal will ask first and foremost for Royal Mail to provide the evidence that the dismissal was fair and reasonable.
So not every case of so called wilful delay is the same. It is true that the penalty for wilful delay is often the same and that is dismissal without notice.

ive recently been dismissed for alleged wilful deley of d2d's and have also lost the appeal despite lack of evidence. 2 witnesses that i worked with were deemed unreliable and not valid as we were friends on facebook????? because i challenged it i now have gross misconduct on my record. a few weeks after i was suspended a lad at work was caught dumping d2d's at a tip. and when his house and car was searched mail and parcels were found albeit unopened but because he was caught redhanded he was offered the chance to resign so it wouldn't cost royal mail money to prosecute! im currently awaiting my employment tribunal!

He can still be prosecuted! even though he has resigned.
The differences are that it will show on his employment record as resigned and Royal Mail wouldn't have to suspend him on full pay pending his dismissal hearing

I am in the process of getting sacked i think. I initially was told by Royal Mail investigation team that I was under suspicion of causing theft of mail. In the hearing I made sure they knew that I had no idea what they were talking about. They were actually accusing me of dumping 49 letters(a bundle) of my walk outdoors in the open. Why would anyone do that?? I genuinely do not know about that. Then they found d2d's in my car along with magazines which I thought were d2d's. I did inform them I had this in the car but they are saying it is a case of wilful delay. Will I be prosecuted and sacked or just one of the above?? Anybody have an idea?

I thought so...have had the interview with delivery lead manager
just sent the notes to that interview off yesterday.

Hi I have just been charged with unexused delaying the mail, some d2d were found at my previous address from 2005 when I worked for the royal mail i left in 2006. but i was arressted by the police and have now been charged and am going to court. I know what i did was wrong but its seem irronic that if i was stii working for the RM i would have just lost my job. Now I have a criminal record and as i run my business if this gets out( which it proberly will )then that goes down the pan.
Also I was a freemason and now with a CR i've had to stop that.
I have know idea what I will receive a court. I have never been in trouble before and this was a long time ago and was 1 silly mistake.

I would imagine savy that if Royal Mail have decided to go to the trouble of prosecuting a six year old case of a former employee then "some D2D" may be skirting around the truth a little.
Just how much D2D are we talking about and how silly was the "mistake"?...and don't expect a great deal of sympathy for your plight on here...these kind of mistakes are usually only mistakes when you get caught.

Agreed. Who would have found the d2ds and instantly thought to contact RM? Let's be honest, if any of us moved into a house and found some d2ds, we'd probably put them straight in the bin and forget about it. Many d2ds are not even marked as Royal Mail's, so making the association is unlikely unless the property has been bought by RM (unlikely as things are), bought by an RM manager (likely? don't think so), or an RM employee (who would most likely have just thrown them in the bin rather than give a toss about the company unless they were a right jobsworth). D2ds are nowhere near as traceable or incriminating as normal mail (oh, sorry, d2ds are normal mail, but you know what I mean) - that's why so many people are still getting away with not delivering them/dumping them/doing what the hell they like. what I was getting at is that if your still a RM employee you get treated differently which is what the original post was about.

But you are no longer working for Royal Mail so they can't sack you, suspend you, or ask you to resign. Does not leave them a lot of choice really does it. It could range anywhere from a fine, community service (around 200 hours seems the average for this offence, suspended sentence or even imprisonment. In most case you will also pay RMs costs as well. But back in 2006 you would have signed saying you delivered them, and been paid as a result so if the Court see's this as fraud they could come down on you quite hard. Well, there's your answer. Just have a quiet word with your brother freemasons. If the old bill dealing with you isn't one, the magistrate probably will be. Just ask the Grand Imperial Wizard (or whatever they're called) of your lodge to put a fix in. And Thorby, masons still have to obey the law of the land they're in, they cannot use their position to get around the law.
