The "YouTube" scenario...

Right, lying in my bed there as I wake up after my nightshift and suddenly a question has entered my head.

As people are facing disciplinary's over posting YouTube vids and then those said vids are REMOVED from the public domain (thus becoming private property) are RM breaking theft, copyright and privacy laws by using these vids in conduct cases as they would need the written consent of the video's owners to show or broadcast these videos??

I think it's a bloody fair point me, but I have put the question to you lot for feedback and opinions. I am going to speak to a friend who is a solicitor over this. I'm sure that the above applies.

Hmmm.... get a life.... OK. What does that mean exactly??? Just coz I said I woke up off nightshift thinking about this??? OK, well, I will get a life when I stop worrying about me and my colleagues getting done over a pro-militancy video on YouTube which was posted and subsequently deleted.

But subsequently, RM are trying to do us on conduct which they have stated in their conduct invitation that we could be investigated for gross misconduct = dismissal which on appeal I would win back, however at the minute I can't be bothered to go through all that scenario as I have been down those roads to many times before. At the minute RM are not following national agreements and picking and choosing what they they want in order to cause bother and I would just like to see a little fairness to my colleagues.

So if my post offends you, apologies, but I thought it was a fair and valid point to bring up!!!

J mate feck saying sorry IF catshole dont like your post.. Its not offensive or rude or sad.... You DID put your point across perfect In my book and i agree... RM are taking the piss and use dirty tricks in my opinion.... I know of such tricks as played in a case not to far from mine.... So J fella i commend you on your thoughtfullness and the fact you stand and say what u believe in.... CLASS!!!

He hasn't posted much and he obviously does not know the history of what J is on about.
When you could be on the verge of losing your job because of SCUM Management i'm sure most of us would be thinking about it all the time.

Don't know much about this, but..

1. If you took it all the way to court, then youtube vids might not be admissable as evidence anyway
2. To get RM for copyright infringement, you'd have to show they were holding a performance of the video. I'd imagine any showing of a video at work would count as a "performance" so you might well be able to get them on it, but it'd involve taking them to court for copyright infringement.

Actually no you might not even need to do that - youtube holds all rights to content uploaded to the site, and users aren't technically allowed to download it:

A. The content on the YouTube Website, except all User Submissions (as defined below), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to YouTube, subject to copyright and other intellectual property rights under the law. Content on the Website is provided to you AS IS for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. YouTube reserves all rights not expressly granted in and to the Website and the Content.

B. You may access User Submissions solely:

* for your information and personal use;
* as intended through the normal functionality of the YouTube Service; and
* for Streaming.

So I'm pretty sure a stiff letter by a solicitor stating they've no rights to use the video, have breached Youtube's terms of use etc. might be enough for them to drop it.

Morning lads and lasses!!

Thanks for the comments and they have been helpful.

I discussed this with the lads last night and we said we would sit tight and see what happens. Catch, thanks for that excert there. Very helpful. I am now constructing a letter to the POD & A for our area for her to kindly return my property - the video as they have no use for it...

I will keep you all posted as I am off to bed in a mo after a cuppa and a ciggy!!!

I'm glad you pointed out the pitfalls of using Youtube stuff.

I was trying to work out how to get the Dodgyclaimers version of "another brick in the wall" onto my MP3 player, for use on the Picket Line. Anyone know how to contact any of them, to ask for an MP3 file direct?
