Can a manager disregard an ATOS rehab plan?
Hello. I'm a rep who has been representing someone returning from long term sick. A manager told me that an ATOS report which contains a rehab plan is purely a guide and does not have to be followed. Is this true? I think the manager is bluffing but could do with having it in writing so that if the need comes to put in a grievance the facts are clear. Thanks!!!

It's morally reprehensible but yes they can and do ignore it. Your only real redress against a poor manager(s) is during a tribunal where it will, and should, look bad. Especially if that persons health deteriorates further because of an unmanageable workload under the conditions.
Why wait? Fire a grievance in now if they do not follow ATOS recommendations. Citing it could be detrimental to the health of the person. If they have already approached a manager go straight to stage two and follow it all the way through. Why refer someone if they subsequently ignore them?
I would also try and get a fit note from my doctor with something I could manage, more evidence to back up my case. There is nothing to stop you doing this if you are returning from work, especially if that doctor had signed you off.
If the health reasons are serious they may be protected under the equalities act 2010

I was going to use the angle that by not adhering to the plan they would be culpable for any further injury or illness suffered by the member. Its a complicated case. The member was due to return on the 14th Feb. The plan was set for this date. He didnt return from sick until the 3rd March. The manager is claiming the plan is therefore invalid. Ihave told them not to assume this is the case and refer him back to ATOS. Everyone thinks they're a doctor! lol

Now my attitude is,if an ATOS doc says what they say then no twonk in my DO can change it.
It's never been changed or challenged at my place.
