Told when to take annual leave

Post by hotxbun »

Hi,
I've just been informed I'm on annual leave next week. I don't want annual leave next week. I've 4½ days to take this "year", can't I carry it over ? I'm not working at my DO at the mo'.
Do I have to take it when I'm told to ?

And usually you find they allocate your last bits to get rid of them.

The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

They don't like you carrying over holiday so they can work our their manning hours for the next year without extra holidays being taken into account. I don't think they can force you to take holiday though. Although I'd be worried about them saying you've lost it.

AFAIA, RM permits you to carry a week over on your AL, anything more is lost....so tell the manager to get bent & if he doesn't get the hint see your rep, and ask to put a disagreement in....imho morally an employer can refuse you AL ( on the basis of a fair allocation has been met ), but I doubt they have any right to tell you when to have time off!

If your employer wants you to take holiday

Your employer can decide when some or all of your holidays must be taken. For instance, they may require you to take some of your holiday to cover the bank holidays, or may require the whole company to take holiday during a Christmas shutdown.

This may be in your contract of employment, or it may be normal practice built up over time. An employer has to give the same amount of notice as you do.

and to expand on Red Letter they have to give you twice the length of holiday as notification. In other words if they wanted you to take 1 week next week they should have told you at the very latest last Monday (28 Feb)

If you want to take holiday

You must give your employer advance notice that you want to take holiday. This notice should be at least twice as long as the amount of holiday you want to take. For example, you should give two weeks' notice for one week's holiday.

Your employer can refuse permission for your holiday as long as they give you notice which is at least as long as the holiday requested. So to refuse a request for a week's leave, they would have to tell you a week in advance.

Your contract may set out other rules about when you can take your holiday. This is allowed so long as the rules don't effectively prevent you from taking holiday at all.

Not quite right,
A Manager can let you carry more so long as he has agreed it with you in advance. ( I'm going to be carrying 5 weeks over this year :Very Happy )

Cor, that's a ... t-o-u-g-h-i-e :hmmmm ... :cuppa

Thanks guys. I'm not based at my DO at mo' so I'll have to call someone in the morning. But who ? Would this have come from the DOM or just the admin guy who looks after A/L, who sent the "note" (and who, by the way, never mentioned anything when I joined RM earlier this year and I handed in a list of dates I'd like off but which didn't include any dates before April) ?

TBF, I've had that myself....but as I was carrying a week over, and they asked me to work a week of AL in March and then carrying that week over as well ( 1 week carried & 1 week AL became 2 weeks carried ) I figured it was so exceptional as to not be worth mentioning.

Just realised, it's 4 days A/L with Friday as my rostered day off, returning to my DO on Saturday (so much for the rehab

with the face-to-face with OH not having happened yet, none of this makes any sense !! :arrrghhh )

hxb, refuse the AL, and let them know it doesn't seem to be inline with your rehab plan, and that you want to speak with OH and check with them first ( especially the going back to your DO bit & preferably name & request the person that came up with your rehab plan ). If they're happy with it AND if you're happy with it, take the time off, but if only you aren't happy you then say something like "No way, you've not given me enough notice, and I'd rather roll my days over to next year." But first thing is to throw the OH spanner into their works :Very Happy :angel

"Use it or lose it", I've been told. :evil/mad Too many spares next week, at both my DO and the office I'm currently working at.
And if leave is taken during the rehab period, you're expected to carry on with the program while you're off. NOT happy.
