Accident at work=No sick pay!!

Postwoman in our office had quite a bad accident last week doing the missort run,fortunately she'll be fine,but with a few broken bones will clearly be off work for some time. She's already received a not blameworthy for the accident as the other driver lost control of his car on ice,causing the head on collision.
Incredibly,because she hasn't worked for Royal Mail for over a year though,she isn't eligible for sick pay and apparently Royal Mail doesn't make exceptions!! Also,Royal Mail takes no responsibility for claiming from the other drivers insurance either,in other words it just wipes it's hands of it's workers without a thought for them :hmmmm (that probably doesn't surprise most of us)

What's even sadder is that she's already intimated that she'll try to come back to work as soon as possible,as being employed only on a temp contract she's worried about her job. :shock: As if it's not bad enough trying to recover from a serious accident without having to worry about your job and having no money too!

I heard it said that you can tell a lot about a company by the way it treats it's staff......how true that is for RM! I should add that the manager in our office is just as disgusted at the situation as the rest of the staff! Any reps out there had similar situations to deal with resolved with any success? I don't think she's in the union,if that does or should make any difference.

Think the company HAS to pay her Statutory Sick Pay, but not 100% certain.

I think she'll still be entitled to SSP, for the little it's worth...

But yes, no sick pay, regardless of the reason she's off.

Could she not seek one of those no win no fee solicitor people and claim lost wages back off the the third party who hit her?

And once again i say it,we are injured in the line of duty and there is no process from RM that covers us,i just don't get it.
I Wrote-During Covid-Which is still relevant now
It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

Of course they do! thats why its call "STATUTORY"!

I hate them to the hilt the blood sucking parasites BUT I think you'd do worse than speaking to a REPUTABLE (if such exist) No Win No fee Accident lawyers. From what been posted you'd probably get a large pay-out.

Coz 99.9% of people would just accept it. Why would RM rush around trying to give money away a 'brick wall' response is far cheaper! Now get a one of those 'No Win No Fee' people involved and RM from what I've heard start being more reasonable! :Very Happy

It's correct to say she will get statutory sick pay,which is just over £78 i think,taken pro-rata of course :roll: against her 30 hour contract leaves her with :hmmmm a pretty piss poor amount to live on! She will of course be able to claim from the other drivers insurance off her own accord,once she's recovered sufficently enough to do so.

If you'd asked me before this happened what Royal Mail would do under these circumstances,i would have thought it would pay her normal sick pay and claim from the other drivers insurance itself,i really should have known better,after all,us common workers are just a number on a computer screen to them,god forbid it should treat us any differently.

As for claiming from Royal Mail,i would think any worker on a temporary contract would be somewhat ill advised to pursue that course of action!

get the union to get there solicitors on to it and go clam your industrial injuries after the 11 week of sick and make sure you fill in all the form of the union for compansation

I think its all a matter of balance.... taking on an insurance company yourself is going to be very hard work where they'll give you the run around hoping you'll give up or settle for a smaller settlement. With one of these NWNF companies they know how to deal with these things and insurance companies just want to settle as quickly as possible as thats the cheapest way to do it.

RM can't decide not to renew your contract because they don't like you they have to have a VALID reason. Remember your NOT suing RM just the drivers insurance company. Your going to need time off to re-cooperate regardless. All this will be factored into the compensation you get.

I believe that the Union has some legal dept BUT I'd go with a NWNF company as they do this sort of thing everyday so have good experience in knowing how to get the most compensation.

It's inexplicable that Royal Mail will do nothing. She was in a Royal Mail vehicle, employed by Royal Mail doing Royal Mail business. It shouldn't matter if she's been employed 50 years or if it's her first day. This can't be right. Surely they have responsibilities. Having said that, if it's as clear cut as it sounds, any decent solicitor (maybe supplied by the union?) should be able to claim full loss of earnings, plus compensation.

Question,who has actually said this,is it the DO manager or higher up.
Has it been pushed.
Has it gone to area/div level yet?
