Got a question for a CWU Rep? And all CWU related matters.

Hi just wondered if anyone could tell me where i stand,i have for the past 7 week been on light duties(doing an odd row/inside work) due to a knee problem which my gp believes is due to it been overworked...
I have tried my best to keep up with everything but just this week my problem has deteriorated and so after another visit to my gp he has told me i have to now have to stay at home and give it good rest at least for 2 weeks until i can get further treatment..
After handing in my sicknote to my line manager i just got the old speal "i presume you can still come in and sit and prep etc"..
After saying you have got my note and so i am taking the time off i then got "well you know this will lead to you been put on a stage and the dom will be phoning you when he comes back in on monday"..
Please could someone tell me if my manager was in the right saying i would be put on a stage when he does not know the outcome and to me this is a work related injury ?
And if my dom does phone me and start asking if i can return to work when my note says i am not fit !!! is this classed as harassment...

this is a work related injury
Was it an AOD? And if yes was it reported as one.

Also yes a stage warning wil be triggered,whether he gives it to you is another thing,but chances are you are on to a loser but you may not get it issued if you have a good rep and it's an AOD.
As for the phone call,when he phones tell him you're sick and that's it,and why have they your number anyway??

Also how long have you been in the job?

Hi Postman i did report it to my line manager the day i was out delivering and the problem started but i dont know if he logged it (well i know damn well he wont) yes he is a total cock..
I have been with them for 6 glorious years now lol,,but i really do not know all the rules and regs....

As for the logging thing,you have to be there to help fill out an AOD form/computer thingy,if you weren't it probably weren't logged ,cock's word against yours.

Postman's right: You should have been allowed to fill in an ERICA Report. Unless it happened in the last few (3 I think) days, it's too late to fill it in now. But that means that they have failed to follow procedure, which should work in your favour. I know it's probably too late telling you that you're entitled to fill it in now. But for anyone else in a similar position, or if you're unlucky enough to have another AOD in the future. DEMAND to fill in an ERICA! It's very important from your point of view. And even more important for your Collegues, because it records the FACT that an AOD has occured, to the HSE. Otherwise, there's the very real risk, of RM failing to report accurate accident rates.

Did you take your Rep in with you, when you told your Manager that you'd been injured?
If so, why didn't he/she tell you this at the time?!?!?
If not, then I can completely understand how this happened.

I hope you get better soon. Good luck with your Stage interview. And for the record: They can, and do, issue Stage warnings for AODs. They gave me one, when I had an AOD. And I'm told that it happens regularly. So long as you aren't already on a Stage 2, I wouldn't worry too much about the Stage warning though. And because of the breach of procedure, you've got a good chance of preventing them giving it to you. It's a technicality I know. But it might be enough.

Sounds like a similar problem to the one I have. Not an accident that causes it but you can feel it going as it goes. Turns out my knees just aren't up to the job

And no i did not take my rep in with me,think i put too much trust in people but looking the way things are going i will deffo watch my back from now on...

After 12 months of no absence I was unfortunate enough to have 2 absences close together. Despite the last one being v serious a stage was issued :evil/mad
Word from office rep is that they can do nothing about a stage 1 or 2.
Not sure who's the biggest cock CWU or managment.

The CWU cant do anything about a stage 1 or 2 because you cant appeal it, not sure how you think the CWU is a cock based on RM procedures but I guess if you want to blame anyone then they are just as easy as anyone.

However, even if the CWU cant do anything you can - if it fits either type you could submit a bullying and harassment complaint, or a redress of grievance. The CWU can't raise it on your behalf but yhey can advise you.

Re. CWU being unable to do anything about Attendance stage 1 and 2.

I last year proposed a motion for our branch to take to annual conference to have the CWU take as their position that whenever they next negotiate the attendance procedure that they demand that appeal procedures are put in place at every stage. The motion was rejected by conference and has been before. The reason being is that CWU don't want to renegotiate the attendance procedure because they believe RM want to reduce allowance for days absent and also the length of sickpay i.e. 6 months full 6 months 1/2. Why would RM agree to putting in appeals that would cost them money unless there was some offerring from the CWU. the CWU believe i guess that at the current moment the current attendance procedure is the best we can get from RM.

However depsite that appeals cannot be made at stage 1 and 2, they can at 3 (yes this is dismissal stage and no one wants it to get that far but...) AT stage 3 any inconsistencies at either previous stages can be argued and are frequently overturned with members facing dismissal reduce back to stage 1s.

There is another option, the grievance procedure. If you feel that there are inconsistencies or that the manager has not operated within RMs procedure then these can be challenged by grievances.

I would very much prefer like most public bodies that there were appeal procedures at every level, but the reality is folks unless members tell the CWU, yeah we'll go on IA for appeals then theres little the CWU can negotiate with.

I may be wrong in this but as far as I know the Union constantly question Royal Mails interpretation of the procedure and they certainly question the mechanistic application of it. If RM actually treated each case individually as per the agreement, and senior managers did not question when Managers failed to issue a stage, then the actual procedure would be a fair one. As is usual its not the actual agreement that's at fault nut RMs application and interpretation - how many times have we heard that.
