Re: sick leave
they will still issue a stage waring even if you never had a back to work interview, it may be that procedure has not been carried out correctly but you will still get your warning, does not say anywhere that if the return to work is not done then you get off(or if it does then please point me in the right direction)Jimmy Carr`s laugh wrote:enzio wrote:have been back at work for one week after being off sick for 8 weeks have not had my back to work interview yet should i have had it buy now allso atos give me a list off things that i should not do what happens about that
Atos will have emailed the info to your manager. If they try to make you do stuff that you have been told not too, remind them what atos said and refuse to do it until they get it in writing from atos that you can do it.
Regarding back to work, we never have um at our place, and its worked numerous times when they try to issue warnings and the the area rep tells them they cant coz we never had a back to work, to which the managers always say they gave one, so the rep asked to see the signed letters, and they can never produce them. Id sit on that, it may be useful to you in future

Re: sick leave
Not in so many words but the implication is there in the following sentence. The implication being if they do not give you a RTW interview then you can go absent again and it all still counts as a single absence towards a stage.cantbelieveit's... wrote:they will still issue a stage waring even if you never had a back to work interview, it may be that procedure has not been carried out correctly but you will still get your warning, does not say anywhere that if the return to work is not done then you get off(or if it does then please point me in the right direction)Jimmy Carr`s laugh wrote:enzio wrote:have been back at work for one week after being off sick for 8 weeks have not had my back to work interview yet should i have had it buy now allso atos give me a list off things that i should not do what happens about that

Further on there is mention of a choice of interviewing or writing to the staff member but that is for issuing the Stage 1 not the Return to work interview.

Re: sick leave
A Return To Work interview is not to be confused with a Stage interview.
The first is not considered part of the formal Attendance Procedure and the second certainly is.
It is all absences up to and including the day of a formal STAGE interview that should be included in the overall review of absence.

3. RETURN TO WORK DISCUSSIONS
When someone returns to work from absence the line manager must aim as soon as possible to speak privately and out of earshot of others with the person in a non-threatening and supportive way outside formal procedures with the following objectives:
· to acknowledge the employee's return and show it is valued
· for the employee to air any concerns
· to see if any help is needed and provide direction to encourage regular attendance
· to ensure absence is appropriately certified
good times, bad times you know I've had my share

Re: sick leave
If a Stage is issued without a return to work being carried out, you have the right to appeal on procedural grounds. This applies to all stages of the attendance procedure even though your Line Manager will undoubtedly try and claim there is no appeal at Stage 1 or 2.cantbelieveit's... wrote: they will still issue a stage waring even if you never had a back to work interview, it may be that procedure has not been carried out correctly but you will still get your warning, does not say anywhere that if the return to work is not done then you get off(or if it does then please point me in the right direction)
