forced overtime /change of hours;

This is something that MAY happen to me soon. Any advice gratefully received. I work part time, afternoons. I rarely/never get offered o/t even at xmas there i got nothing. Now, with a few going sick i am being warned i may get asked to do mornings, on o/t. I DONT want it, can they chagne my duty to mornings then if I say i dont want the o/t, to make me do the work (never worked mornings in the 2.5 years i have been there). Some notice due surely? thanks in advance.

It's 28 days notice to change your hrs,it's executive action if they do,get your rep to get the ADR involved.
Oh and ot is voluntary.

Oh are you on a 'rolling' contract as that changes things.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

Was made substantive after trial, no mention of rolling, just permanent. Thanks for the prompt reply, 28 days is less than i thought but better than nowt.

Duble check your contract,and also 28 days/28 weeks it's EA if you are permanent.

28 days is a myth all Employment Law states is that 'reasonable' notice should be given to an employee. Also at interview you were most likely asked would you be prepared to vary your attendances if required and say a bit later or start earlier from time to time. All these things are a matter for an ET and most people would not bother taking it that far. Your only recourse is to play the 'family friendly' card but if you didn'tmention this at interview RM can 'reasonably' ask you to alter your attendance pattern. Your contract will simply state you are employed on a permanent/temporary basis at x hours a week. No mention is made of attendance times or location.

Make sure you check your contract and see what it says regarding your hours of work. Most short term contracts and some of the newer part time contracts do say you must be able to change your hours with reasonable notice... But saying that its a grey area according to my union rep. If they do try to change your hours go and see your rep and see what he has to say!

Depending on what he comes back with regarding his contract it's 'EA'!
A good rep and ADR should be able to throw this out without him having to grovell for FF hrs.

The contract is crystal clear ( for Royal Mail); It is a "permanent contract" ......., " hours of attendance may vary with reasonable notice as per national agreements" , plus the usual "operational need " clause for overtime.

Just because the have added that contract clause doesnt mean that it is set in stone. I had a simular arguement with royal mail and my union rep and the out come we came to is that you have to agree to the change as well. The clause could be used to get rid of you because they feel you are being 'inflexible' but it doesnt help them not to have someone for either shift!

Im 25 hr contract and was told all of us 25's will be made up to 27.5 .

I told him i cant do it and he said i had no choice .

Well im 9 - 2 shift . I drop kids at school at ten to nine then off to work . THEN i have to take one of the kids to nursery as close to half one as possible .

WHERE would the extra time they want me to take on be put ??? SATURDAY ? ? ? Not a fkin chance .

It will be interesting to say the least . Any ideas ? ? ?

The guys at our place on 27.5 hours have two early starts, one of which is on Saturday in addition to a weekday of the manager's choosing.

In my opinion this one does sound like an easy one to fight against! If it says 25 hours then thats all you have agreed to and they cant force you to change your contract! Now if they said you had to do it on OT then that would drift into a grey area... Did you tell them you have kids at your interview?

On a 30hr contract, with Tuesday my day off. They tried to change and make me have alternate days off. Told them NO, as have 2 year old at nursery and he is home with me then and cannot get any1 to look after him, nor can I get him into nursery as they have limits. That was 4 weeks ago and nothing since. They have sh*t on me every way possible but at least they didn't try with any rubbish regarding changing my day off
