How long should i get for meal relief, i do 5 hour shifts.

Should be 30 minutes for Attendance length 5 hours to 7 hours.

less than 2 hours 30 minutes... none (a 10 min grace break should be provided if work permits)
2 hours 30 to 3 hours... 10 mins... 10
3 hours 1 to 3 hours 30... 15 mins... 15
3 hours 31 to 4 hours 59... 20 mins... 20
5 hours to 7 hours... 30 mins... 30
7 hours 1 to 8 hours 59... 40 mins... 40 or 20 + 20
9 hours to 10 hours 59... 50 mins... 30 + 20
11 hours to 12 hours 59... 60 mins... 40 + 20 or 30 + 30
13 hours or longer... 70 mins... 40 + 30

Does the attendance length include the break? This comes up at my office every now and again. I've always argued for 30 mins (on a 25 hr contract). A new thing they are trying is saying that I work 4:40 (with a twenty min break) and so am not entitled to 30 mins.

They are trying it on. If you have a 5 hour attendance (paid for 5 hours) you are entitled to a 30 minute break.

Yes 100% it does after all it is a paid break and therefore working time on 5 hour day would be 4:30. The agreement states ATTENDANCE as the qualifier not working time.

Problem that keeps cropping up in our DO is Pters "Stepping Up" to cover a FT duty. DIM keeps trying to tell them they're only entitled to their contracted Meal Relief. i.e. You're on a 20 hr contract you only get 20 mins.

Our view point is if you're covering an 8 hr delivery you're entitled to a 40 min MR!

Actually found a new guy the other week who wasn't taking, or claiming, any MR at all! In his defence no one had even bothered to explain it to him so he was directed to the Local Rep. The Rep annoyed me by saying there was no way he'd be able to claim back the 3 months of MR he was owed! I told him to give him a list of the dates and then put in a grievance if he didn't get his money. As usual new guys on rolling contracts don't want to "Rock the Boat" and are worried about upsetting the DIM! This company must be saving a fortune in unpaid allowances, and to think they class themselves a world class leaders!

Its not based on contracted hours but attendance on a particular day.

if a 20 hour Postie normally works 4 hours then their break (although it wont be a statutory one) will be 20 minutes.
If he comes in to do a FT walk but still only works 4 hours then they still only get 20 minutes.
If however they do the prep and delivery and do 6 hours they get 30 minutes.
If the do a full 8 hours like a FT then they get 40 minutes

Cheers TBT thought that was right. Just the DIM trying to save himself 20mins for his next bonus. I've got a copy the MR crib sheet in my diary but he still wants to argue. It's time like these you need an ProActive Rep but so many of them just want an easy time.

Don't argue with him,get the office in the canteen and tell the prick if he does not adhere to a NATIONAL AGREEMENT then you will stay there until he does!
